Sec. 223.103. CERTIFICATION OF EMERGENCY.
(a)Before awarding a contract under this subchapter, the director or a person the director designates must certify in writing a description of the highway emergency.
(b)A person designated under Subsection (a) may not occupy a position below the level of deputy director.
