Sec. 1501.310. ELECTION OF STATUS.
(a)Each small employer health benefit plan issuer shall notify the commissioner of the issuer's election to operate as a risk-assuming health benefit plan issuer or as a reinsured health benefit plan issuer. An issuer that elects to operate as a risk-assuming health benefit plan issuer shall file an application in accordance with Section 1501.312 .
(b)A small employer health benefit plan issuer's election under this section is effective until the fifth anniversary of the date of the election.
(c)The commissioner may permit a small employer health benefit plan issuer to modify its election at any time for good cause shown.
