(a) A person may not operate a food service establishment, retail food store, or temporary food service establishment located in an area in which a county or public health district does not require a permit or conduct inspections under this chapter unless the person has a permit issued by the department.
(b) A person required to obtain a permit under Subsection (a) must apply every two years for the permit and must pay any fees required by the department.
