Sec. 383.012. LOCATION OF CONTROL FACILITY.

(a)A control facility may be located on the property of any person.

(b)A control facility of a municipality must be located in whole or in part within:

(1)the boundaries of the municipality; or

(2)the municipality's extraterritorial jurisdiction, as determined under Chapter 42 , Local Government Code.

(c)A control facility of a river authority may be located outside the river authority's boundaries if it is located in whole or in part within the river authority's river basin or a coastal basin adjoining the river authority's boundaries. A control facility of a river authority may be located anywhere in the state if it is financed at the same time and with the same bond issue as a control facility located within the river authority's boundari
