Sec. 830.101. ELIGIBILITY TO PARTICIPATE.
(a)The governing board of each institution of higher education shall provide an opportunity to participate in the optional retirement program to all faculty members in the component institutions governed by the board. The State Board of Education shall provide an opportunity to participate in the optional retirement program to the commissioner of education.
(b)Eligibility to participate in the optional retirement program is subject to rules adopted by the Texas Higher Education Coordinating Board.
(c)A person who before September 1, 1987, had chosen to participate in the optional retirement program and who was participating in the program on September 1, 1987, is entitled to continue to participate in the program until the person terminates part
