Text

(a)The commissioner may reject the application of any person for admission to an assessment or may strike the name of a person from a pool, if the department determines that the applicant:
(1)Lacks any of the required qualifications;
(2)Is incapable of performing the essential functions of the position that the applicant is seeking;
(3)Has been convicted of a crime rendering the applicant unsuitable for a particular position;
(4)Has been dismissed for cause from state service;
(5)Has made a false statement of a material fact; or (6) Committed or attempted to commit a fraud or deception in connection with submitting an application or attempting to secure an appointment to state service.
(b)Any person whose name is removed from a pool of candidates for any reason shall be notified.
