Text

(a)A person supported shall not receive care at the expense of the state in a program operated by the department, except:
(1)A person who is indigent;
(2)A person subject to evaluation, diagnosis, or treatment, under chapter 5, parts 4 and 5 of this title;
(3)A person whose service is paid for, in part, by state or federal government and the payment is conditioned on the department's acceptance of it as full satisfaction of the person's liability; or (4) A person whose service is paid for by the person supported or another person or a third party and the department determines, under standards developed in consultation with the comptroller of the treasury and approved by the commissioner of finance and administration, that the state's interests are best served by accepting payment offer
