§ 34-48A-22 — Emergency management workers--Rights, duties, and compensation.

An emergency management worker while on duty, whether within or without the state, shall: (1) If the worker is an employee of the state, have the powers, duties, rights, privileges, and immunities and receive the compensation incidental to the worker's employment; (2) If the worker is an employee of a political subdivision of the state, and whether serving within or without such political subdivision, have the powers, duties, rights, privileges, and immunities and receive the compensation incidental to the worker's employment; (3) If the worker is not an employee of the state or a political subdivision thereof, be compensated by the state at a rate set by rules promulgated pursuant to chapter 1-26 by the secretary, and have the same rights and immunities as are provided by law for the employees of this state; and (4) Be subject to the operational control of the authority in charge of emergency management activities in the area in which the worker is now serving.
