(A)To ensure equitable treatment and personal safety of all scholarship students, all education service providers shall:
(1)comply with all applicable health and safety laws or codes;
(2)hold a valid occupancy permit if required by the municipality in which the education service provider is located;
(3)not unlawfully discriminate on the basis of race, color, or national origin. This item shall not be interpreted to preclude any independent or religious educational provider from exercising an exemption allowed under federal law;
(4)conduct and maintain records of completed criminal background checks on employees. An education service provider that is not an accredited or licensed school must submit documentation of completed background checks to the department as part of their initial

HISTORY: 2023 Act No. 8 (S.39), SECTION 1, eff June 3, 2023; 2025 Act No. 11 (S.62), SECTION 10, eff May 7, 2025. Editor's Note 2023 Act No. 8, SECTION 3, provides as follows: "SECTION 3. This act takes effect thirty days after approval by the Governor, provided that upon approval of this act by the Governor, the Department of Education shall begin undertaking and executing responsibilities incidental to the implementation of this act so that the provisions of this act may be fully implemented thirty days after approval by the Governor." 2025 Act No. 11, SECTION 16, provides as follows: "SECTION 16. This act takes effect upon approval by the Governor. Current eligible participants may continue receiving benefits under the Education Scholarship Trust Fund, until the end of the 2024-2025 School Year." Effect of Amendment 2025 Act No. 11, SECTION 10, rewrote (A)(4); in (B)(1), substituted "an invoice, for services purchased, or a receipt for goods purchased" for "a receipt"; in (B)(2), inserted the second sentence; rewrote (C)(1); in (F), deleted "autonomous and" preceding "not an agent"; in (F)(1), inserted "beyond what is set forth in this chapter"; in (F)(4) and (F)(5), deleted "by a parent" preceding "from an ESTF account"; and made nonsubstantive changes.
