The provisions of this article do not apply to hospitals owned by the Department of Behavioral Health and Developmental Disabilities or operated by the Office of Mental Health or by specialized hospitals licensed exclusively for treatment of alcohol or drug abuse and which are under contract with the Office of Substance Use Services, a component office of the Department of Behavioral Health and Developmental Disabilities.

HISTORY: 2005 Act No. 146, SECTION 1, eff upon approval (became law without the Governor's signature on June 8, 2005); 2007 Act No. 29, SECTION 1, eff upon approval (became law without the Governor's signature on May 16, 2007). Code Commissioner's Note At the direction of the Code Commissioner, certain references in the S.C. Code to the State Department of Mental Health, South Carolina Mental Health Commission, Department of Disabilities and Special Needs, Department of Disabilities and Special Needs Commission, Department of Alcohol and Other Drug Abuse Services, and other related terms were changed to reflect the restructuring of these agencies into component offices under the Department of Behavioral Health and Developmental Disabilities, pursuant to 2025 Act No. 3, SECTION 18.
