§ 61-6-4450 — Distribution of proceeds.
If delivery is not demanded by the claimant or claimants in a proceeding under Section 61-6-4390, the court must order the sale of the chattel by the sheriff. Out of the proceeds of the sale the following must be paid in the following order of priority:
(1)the claim or claims allowed in order of their priority as determined by the court;
(2)the costs; and (3) the residue must be paid to the municipality or to the county treasurer as set forth in Section 61-6-4380. If no claim is proven and established as provided in this section, the court must order the sale of the chattel by the sheriff and the proceeds from the sale, after payment of costs, paid as set forth in this section.
