The building official may obtain injunctive relief from a court of competent jurisdiction to enjoin the offering for sale, delivery, use, occupancy, erection, alteration, or installation of a building covered by this chapter, upon an affidavit from the building official specifying the manner in which the building does not conform to the requirements of this chapter.

HISTORY: 1979 Act No. 156, SECTION 9; 2009 Act No. 46, SECTION 1, eff July 1, 2009. Editor's Note 2009 Act No. 46 SECTION 3, effective July 1, 2009, provides as follows: "The provisions of this act do not apply to projects which have received the proper permits as required by law before the effective date of this act." Effect of Amendment The 2009 amendment substituted "The building official" for "Any local enforcement agency of the Council", "the building official" for "such agency", deleted from the end "or the South Carolina Building Energy Efficiency Standard", and made nonsubstantive changes throughout.
