§ 9-22-12. Discharge or discontinuance as to codefendant.
Whenever several persons shall be made defendants in any action and the action shall
            be discontinued as to any one or more of the defendants, or if, upon the trial thereof,
            any one or more of them shall be acquitted by verdict or upon motion, every defendant
            so discharged or acquitted shall have and recover his or her costs.
