§ 33-11-11. Provision for payment of contingent claim not conclusive as to validity — Restrictions
               on action to enforce claim.
The decision of the probate court as to depositing assets or giving bond upon the
            contingent claim of a creditor shall not be conclusive as to the validity of the claim
            against the personal representative or other party interested to oppose the allowance
            thereof; and the personal representative shall not be compelled to pay the claim,
            unless it is proved to be due in an action commenced by the claimant within one year
            after its claim becomes payable. In case of suit against the personal representative,

The decision of the probate court as to depositing assets or giving bond upon the contingent claim of a creditor shall not be conclusive as to the validity of the claim against the personal representative or other party interested to oppose the allowance thereof; and the personal representative shall not be compelled to pay the claim, unless it is proved to be due in an action commenced by the claimant within one year after its claim becomes payable. In case of suit against the personal representative, recovery shall be limited to the assets in the registry of the court deposited as provided in § 33-11-9.
