Text
A.Any person found to have committed any violation of paragraphs 1 through 6 of subsection A of Section 1005 of this title shall be deemed guilty of Medicaid fraud. B.
1.Any person committing Medicaid fraud where the aggregate amount of payments illegally claimed or received is One Thousand Dollars ($1,000.00) or more shall be guilty of a felony, and upon conviction thereof shall pay a fine of not more than three times the amount of payments illegally claimed or received or Ten Thousand Dollars ($10,000.00) whichever is greater, or be imprisoned for not more than three (3) years, or by both such fine and imprisonment.
2.Any person committing Medicaid fraud where the aggregate amount of payments illegally claimed or received is less than One Thousand Dollars ($1,000.00) shall be guilty o
