When the officers having control or management of a public cemetery deem it necessary to appropriate property for a new and better approach to the cemetery, and have passed a resolution declaring the necessity thereof and their intention to make such appropriation, they shall make application to the court of common pleas or to a judge thereof in vacation, or to the probate court of the county in which the property or a part thereof is located, in the manner prescribed in section163.05of the Revised Code, and the proceedings therefor shall be conducted as prescribed by sections163.01to163.22, inclusive, of the Revised Code.
