All contracts under section6117.41of the  Revised Code shall provide for the payment of compensation to the  county or other public agency owning, acquiring, or constructing,  or agreeing to acquire or construct, the sanitary or drainage  facilities or prevention or replacement facilities to be jointly  used in an amount agreed upon as the other party's share of the  cost of acquiring or constructing the facilities. The contract  also shall provide for payment of compensation to the county or  other public agency owning, acquiring, or constructing the  facilities and operating and maintaining them in an amount agreed  upon as the other party's share of the cost of operating and  maintaining them or, in lieu of all other or differing payments,   and agreed price per unit of flow.
