Text

(A)Except as provided in division (E) of this section, a health plan issuer is not required to grant a request for a standard external review made under section3922.08or3922.10of the Revised Code until the covered person has exhausted the health plan issuer's internal appeal process.
(B)An internal appeal process shall be considered exhausted if a covered person has requested an internal appeal and has not received a written decision from the health plan issuer within the time frame required by 29 C.F.R. 2560.503-1 or the health plan issuer fails to adhere to all requirements of the internal appeals process.
(C)Notwithstanding division (B) of this section, the internal appeals process will not be deemed exhausted based on de minimis violations that do not cause, and are not
