§ 1144-a. Operation of vehicles when approaching a parked, stopped or\nstanding authorized emergency vehicle, hazard vehicle, vehicle\ndisplaying a blue or green light or certain other motor vehicles.
(a)\nEvery operator of a motor vehicle shall exercise due care to avoid\ncolliding with an authorized emergency vehicle which is parked, stopped\nor standing on the shoulder or any portion of such highway and such\nauthorized emergency vehicle is displaying one or more red or\ncombination red and white lights pursuant to the provisions of paragraph\ntwo of subdivision forty-one of section three hundred seventy-five of\nthis chapter or is displaying one or more blue, combination blue and red\nor combination blue, red and white lights pursuant to the provisions of\nsubparagraph b of paragraph

§ 1144-a. For operators of motor\nvehicles on parkways or controlled access highways, such due care shall\ninclude, but not be limited to, moving from a lane which contains or is\nimmediately adjacent to the shoulder where such authorized emergency\nvehicle displaying one or more red, blue or white or any combination of\nred and white lights or blue or combination blue and red or combination\nblue, red and white lights pursuant to the provisions of paragraph two\nor subparagraph b of paragraph four, as applicable of subdivision\nforty-one of section three hundred seventy-five of this chapter is\nparked, stopped or standing to another lane, provided that such movement\notherwise complies with the requirements of this chapter including, but\nnot limited to, the provisions of sections eleven hundred ten of this\ntitle and eleven hundred twenty-eight of this title.\n (b) Every operator of a motor vehicle shall exercise due care to avoid\ncolliding with a hazard vehicle which is parked, stopped or standing on\nthe shoulder or on any portion of such highway and such hazard vehicle\nis displaying one or more amber lights pursuant to the provisions of\nparagraph three of subdivision forty-one of section three hundred\nseventy-five of this chapter or, if such hazard vehicle is designed for\nthe towing or pushing of disabled vehicles such hazard vehicle is\ndisplaying one or more amber lights or one or more blue or combination\nblue and amber lights pursuant to the provisions of paragraph three or\nsubparagraph b-1 of paragraph four, as applicable, of subdivision\nforty-one of section three hundred seventy-five of this chapter or, if\nsuch hazard vehicle owned and operated by the state or by a county,\ncity, town or village is designed for the removal of ice and snow such\nhazard vehicle is displaying one or more amber lights or one or more\ngreen or combination green and amber lights pursuant to the provisions\nof paragraph three or subparagraph (c) of paragraph five, as applicable,\nof subdivision forty-one of section three hundred seventy-five of this\nchapter. For operators of motor vehicles on parkways or controlled\naccess highways, such due care shall include, but not be limited to,\nmoving from a lane which contains or is immediately adjacent to the\nshoulder where (i) such hazard vehicle displaying one or more amber\nlights pursuant to the provisions of paragraph three of subdivision\nforty-one of section three hundred seventy-five of this chapter or (ii)\nsuch hazard vehicle designed for the towing or pushing of disabled\nvehicles displaying one or more amber lights or one or more blue or\ncombination blue and amber lights pursuant to the provisions of\nparagraph three or subparagraph b-1 of paragraph four, as applicable, of\nsubdivision forty-one of section three hundred seventy-five of this\nchapter or (iii) such hazard vehicle owned and operated by the state or\nby a county, city, town or village is displaying one or more amber\nlights or one or more green or combination green and amber lights\npursuant to the provisions of paragraph three or subparagraph (c) of\nparagraph five, as applicable, of subdivision forty-one of section three\nhundred seventy-five of this chapter, is parked, stopped or standing to\nanother lane, provided that such movement otherwise complies with the\nrequirements of this chapter including, but not limited to, the\nprovisions of sections eleven hundred ten and eleven hundred\ntwenty-eight of this title.\n (c) Every operator of a motor vehicle shall exercise due care to avoid\ncolliding with a vehicle displaying a blue light pursuant to the\nprovisions of paragraph four or a green light pursuant to the provisions\nof paragraph five of subdivision forty-one of section three hundred\nseventy-five of this chapter which is parked, stopped or standing on the\nshoulder or any portion of such highway. For operators of motor vehicles\non parkways or controlled access highways, such due care shall include,\nbut not be limited to, moving from a lane which contains or is\nimmediately adjacent to the shoulder where such vehicle displaying a\nblue light pursuant to the provisions of paragraph four or a green light\npursuant to the provisions of paragraph five of subdivision forty-one of\nsection three hundred seventy-five of this chapter is parked, stopped or\nstanding to another lane, provided that such movement otherwise complies\nwith the requirements of this chapter including, but not limited to, the\nprovisions of sections eleven hundred ten and eleven hundred\ntwenty-eight of this title.\n (d) Every operator of a motor vehicle on a parkway and on a\ncontrolled-access highway shall exercise due care to avoid colliding\nwith a motor vehicle which is parked, stopped or standing on the\nshoulder or any portion of such parkway or controlled-access highway.\nFor the purposes of this subdivision, such due care shall include, but\nnot be limited to, moving from a lane which contains or is immediately\nadjacent to the shoulder where such motor vehicle is parked, stopped or\nstanding to another lane, provided that such movement otherwise complies\nwith the requirements of this chapter including, but not limited to, the\nprovisions of sections eleven hundred ten and eleven hundred\ntwenty-eight of this title.\n
