§ 480. Expenditure of moneys.
1.In accordance with the provisions of\nthe rebuild and renew New York transportation bond act of two thousand\nfive authorizing the creation of general obligation debt in the amount\nof two billion nine hundred million dollars ($2,900,000,000), the moneys\nreceived by the state from the sale of bonds and/or notes shall be\nexpended for uses eligible pursuant to the rebuild and renew New York\ntransportation bond act of two thousand five pursuant to annual\nappropriations as follows:\n (a) One billion four hundred fifty million dollars ($1,450,000,000) as\nauthorized by subdivision two of this section; and\n (b) One billion four hundred fifty million dollars ($1,450,000,000) as\nauthorized by subdivision two of section twelve hundred seventy-f of the\npub

Program distribution. The moneys received by the state from the\nsale of bonds sold pursuant to the rebuild and renew New York\ntransportation bond act of two thousand five for uses eligible pursuant\nto subdivision a of section four of the rebuild and renew New York\ntransportation bond act of two thousand five shall be expended for the\nfollowing transportation programs, pursuant to annual appropriations:\n One billion four hundred fifty million dollars ($1,450,000,000) for\nthe construction, reconstruction, replacement, improvement,\nreconditioning, rehabilitation and preservation, including engineering,\nconstruction management, site preparation, clearances, the preparation\nof designs, plans, specifications, estimates, environmental impact\nstatements, appraisals and surveys, and the acquisition of real property\nand interests therein required or expected to be required in connection\ntherewith, of: state highways, bridges and parkways; highways and\nbridges off the state highway system necessary or reasonably expected to\nbe necessary as a project component or incidental to projects otherwise\nauthorized by this paragraph in relation to the canal system and\nappurtenances thereto; highways and bridges either on or off the state\nhighway system necessary or reasonably expected to be necessary as a\nproject component or incidental to projects otherwise authorized by this\nparagraph in relation to airports and aviation facilities, ports,\nomnibus, mass transit, rapid transit and rail projects; border crossing\nenhancements either on or off the state highway system; the improvement\nand/or elimination of highway-railroad grade crossings either on or off\nthe state highway system; pedestrian and/or bicycle trails, pathways and\nbridges that serve transportation needs; the canal system and\nappurtenances thereto, including moveable bridges that cross over the\ncanal system, canal infrastructure improvement and enhancement projects,\nand improvement and enhancement of canal harbors, service ports, marine\nterminals and marine transportation facilities on the canal system;\nairports and aviation facilities, equipment and related projects,\nexclusive of those airports and facilities under the jurisdiction of the\nport authority of New York and New Jersey or operated by the state of\nNew York; ports, marine terminals and marine transportation facilities\nexclusive of those under the jurisdiction of the port authority of New\nYork and New Jersey; omnibus, mass transit and rapid transit systems,\nfacilities, and equipment, including acquisition, exclusive of those\noperated or acquired by or under the jurisdiction of the metropolitan\ntransportation authority and its subsidiaries, the New York city transit\nauthority and its subsidiaries and the Triborough bridge and tunnel\nauthority; urban, commuter and intercity passenger rail, freight rail,\nand intermodal passenger and freight facilities and equipment, including\nalterations necessary to improve track clearances, and also including\nfacilities used jointly by commuter railroad companies and freight\nrailroad companies, but otherwise exclusive of those operated by or\nunder the jurisdiction of the metropolitan transportation authority and\nits subsidiaries, the New York city transit authority and its\nsubsidiaries and the Triborough bridge and tunnel authority.\n
