§ 89-e. Alzheimer's disease assistance fund.
1.There is hereby\nestablished in the joint custody of the commissioner of taxation and\nfinance and the comptroller, a special fund to be known as the\n"Alzheimer's disease assistance fund".\n 2. Such fund shall consist of all revenues received by the department\nof taxation and finance, pursuant to the provisions of section six\nhundred twenty-nine of the tax law and all other moneys appropriated,\ncredited, or transferred thereto from any other fund or source pursuant\nto law. § 89-e. Alzheimer's disease assistance fund. 1. There is hereby\nestablished in the joint custody of the commissioner of taxation and\nfinance and the comptroller, a special fund to be known as the\n"Alzheimer's disease assistance fund".\n 2. Such fund shall consist of all revenues received by the department\nof taxation and finance, pursuant to the provisions of section six\nhundred twenty-nine of the tax law and all other moneys appropriated,\ncredited, or transferred thereto from any other fund or source pursuant\nto law. For each state fiscal year, there shall be appropriated to the\nfund by the state, in addition to all other moneys required to be\ndeposited into such fund, an amount equal to the amounts of monies\ncollected and deposited into the fund pursuant to section six hundred\ntwenty-nine of the tax law during the preceding calendar year, as\ncertified by the comptroller. Nothing contained herein shall prevent the\nstate from receiving grants, gifts or bequests for the purposes of the\nfund as defined in this section and depositing them into the fund\naccording to law.\n 2-a. On or before the first day of February each year, the comptroller\nshall certify to the governor, temporary president of the senate,\nspeaker of the assembly, chair of the senate finance committee and chair\nof the assembly ways and means committee, the amount of money deposited\nin the Alzheimer's research fund during the preceding calendar year as\nthe result of revenue derived pursuant to section six hundred\ntwenty-nine of the tax law.\n 2-b. On or before the first day of February each year, the\ncommissioner of health shall provide a written report to the temporary\npresident of the senate, speaker of the assembly, chair of the senate\nfinance committee, chair of the assembly ways and means committee, chair\nof the senate committee on health, chair of the assembly health\ncommittee, the state comptroller and the public. Such report shall\ninclude how the monies of the fund were utilized during the preceding\ncalendar year and shall include:\n (i) the amount of money dispersed from the fund and the award process\nused for such disbursements;\n (ii) recipients of awards from the fund;\n (iii) the amount awarded to each;\n (iv) the purposes for which such awards were granted; and\n (v) a summary financial plan for such monies which shall include\nestimates of all receipts and all disbursements for the current and\nsucceeding fiscal years, along with the actual results from the prior\nfiscal year.\n 3. Moneys in the Alzheimer's disease assistance fund shall be kept\nseparate and shall not be commingled with any other moneys in the\ncustody of the commissioner of taxation and finance and the comptroller.\n 4. The moneys in such fund shall be expended only for the purposes\nspelled out in paragraph (b) of subdivision six of section twenty-seven\nhundred one of the public health law.\n 5. All payments form such fund shall be made by the department of\ntaxation and finance after audit and warrant of the comptroller on\nvouchers approved by the commissioner of health.\n
