§ 43-A — Payment of judgments of the court of claims in certain cases arising out of the appropriation of property by the state

§ 43-a. Payment of judgments of the court of claims in certain cases\narising out of the appropriation of property by the state. Whenever a\njudgment of the court of claims is rendered against the state for\ndamages arising out of the appropriation by the state of property\npursuant to section twenty-seven of the agriculture and markets law,\nsection forty of the canal law, sections thirteen and six hundred\nseventy-six-a of the conservation law, section twenty-one of the\ncorrection law, sections three hundred seven and three hundred\nfifty-five of the education law or either of said last-mentioned\nsections, section two hundred thirteen of the executive law, sections\ntwenty-nine and thirty of the highway law, section thirty of the highway\nlaw for any of the purposes authorized by section twelve of said law,\narticle seventy-one of the mental hygiene law, section one hundred\nseventy-seven of the military law, section four hundred one of the\npublic health law, section forty of the social welfare law, chapter six\nhundred seventy-eight of the laws of nineteen hundred twenty-eight\nconstituting the grade crossing elimination act, as amended, or chapter\neight hundred sixty-two of the laws of nineteen hundred thirty-six, as\namended, the amount, if any, of such judgment, inclusive of interest\nthereon as allowed by law, which exceeds the amount of moneys otherwise\nappropriated and available for the payment thereof shall be paid out of\nthe state treasury from moneys appropriated to the court of claims for\ngeneral state charges.\n
