§ 251 — Saving clause

§ 251. Saving clause. Nothing contained in this chapter shall be\nconstrued to repeal any statute of the state or ordinance of the city or\nrule or regulation of the board of health, not inconsistent with the\nprovisions of this chapter, and the same shall remain in full force and\neffect, when not inconsistent with the provisions of this chapter, to be\nconstrued and operated in harmony with its provisions. The powers which\nare conferred and the duties which are imposed upon any officer or\ndepartment of the city under any statute of the state, or any city\nordinance which is in force at the time of the taking effect of this\nchapter shall, if such office or department be abolished by this\nchapter, be thereafter exercised and discharged by the officer, board or\ndepartment upon whom is imposed corresponding or like functions, powers\nand duties under the provisions of this chapter. Where any contract has\nbeen entered into by the city prior to the time of the taking effect of\nthis chapter, or any bond or undertaking has been given to or in favor\nof the city, which contains provisions that the same may be enforced by\nsome officer, board or department therein named, but by the provisions\nof this chapter such office, board or department is abolished, such\ncontracts, bonds and undertakings shall not in any manner be impaired,\nbut shall continue in full force, and the powers conferred and the\nduties imposed with reference to the same upon the officer, board or\ndepartment which has been abolished, shall thereafter be exercised and\ndischarged by the officer, board or department upon whom is conferred or\nimposed like powers, functions or duties under the provisions of this\nchapter. The park commission, in any city, which at the time this\nchapter takes effect, has jurisdiction of its park system, is continued\nin office notwithstanding the provisions of this chapter, with all the\npowers and subject to all the duties, conferred and imposed upon such\ncommission by law.\n
