§ 603. Eligibility for service retirement benefits; age and service\nrequirements. * a. The service retirement benefit specified in section\nsix hundred four of this article shall be payable to members who have\nmet the minimum service requirements upon retirement and attainment of\nage sixty-two, other than members who are eligible for early service\nretirement pursuant to subdivision c of section six hundred four-b of\nthis article, subdivision c of section six hundred four-c of this\narticle, subdivision d of section six hundred four-d of this article,\nsubdivision c of section six hundred four-e of this article, subdivision\nc of section six hundred four-f of this article, subdivision c of\nsection six hundred four-g of this article, subdivision c of section six\nhundred four-h of this article subdivision c of section six hundred\nfour-i of this article, or subdivision c of section six hundred four-j\nof this article, provided, however, a member of a teachers' retirement\nsystem or the New York state and local employees' retirement system who\nfirst joins such system before January first, two thousand ten or a\nmember who is a uniformed court officer or peace officer employed by the\nunified court system who first becomes a member of the New York state\nand local employees' retirement system before April first, two thousand\ntwelve may retire without reduction of their retirement benefit upon\nattainment of at least fifty-five years of age and completion of thirty\nor more years of service, provided, however, that a uniformed court\nofficer or peace officer employed by the unified court system who first\nbecomes a member of the New York state and local employees' retirement\nsystem on or after January first, two thousand ten and retires without\nreduction of their retirement benefit upon attainment of at least\nfifty-five years of age and completion of thirty or more years of\nservice pursuant to this section shall be required to make the member\ncontributions required by subdivision f of section six hundred thirteen\nof this article for all years of credited and creditable service,\nprovided further that the preceding provisions of this subdivision shall\nnot apply to a New York city revised plan member.\n * NB Effective until ch. 682/2003 expires and only so long as certain\nconditions are met (see chapter 55 of 2024 Part EE, § 5 (a))\n * a. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members who have met the\nminimum service requirements upon retirement and attainment of age\nsixty-two, other than members who are eligible for early service\nretirement pursuant to subdivision c of section six hundred four-b of\nthis article, subdivision c of section six hundred four-c of this\narticle, subdivision d of section six hundred four-d of this article,\nsubdivision c of section six hundred four-e of this article, subdivision\nc of section six hundred four-f of this article, subdivision c of\nsection six hundred four-g of this article, subdivision c of section six\nhundred four-h of this article or subdivision c of section six hundred\nfour-i of this article provided, however, a member who is a peace\nofficer employed by the unified court system or a member of a teachers'\nretirement system or the New York state and local employees' retirement\nsystem may retire without reduction of his or her retirement benefit\nupon attainment of at least fifty-five years of age and completion of\nthirty or more years of service.\n * NB Effective when ch. 682/2003 expires\n a-1. For members who first become a member of a public retirement\nsystem of the state on or after April first, two thousand twelve, the\nservice retirement benefit specified in section six hundred four of this\narticle shall be payable to members who have met the minimum service\nrequirements upon retirement and have attained age sixty-three.\n * b. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are correction\nofficers of the Westchester county correction department as defined in\nsection eighty-nine-e of this chapter if: (i) such members have met the\nminimum service requirements upon retirement, and (ii) in the case of a\nmember subject to the provisions of article fourteen of this chapter,\nsuch member files an election therefor which provides that he or she\nwill be subject to the provisions of this article and to none of the\nprovisions of such article fourteen. Such election, which shall be\nirrevocable, shall be in writing, duly executed and shall be filed with\nthe comptroller on or before December thirty-first, nineteen hundred\nninety. For the purposes of this subdivision, the term "creditable\nservice" shall have the meaning as so defined in both sections\neighty-nine-e and six hundred one of this chapter.\n * NB There are 2 sb b's\n * b. Notwithstanding the provisions of subdivision a of this section,\na member of the New York city employees' retirement system, who is\nemployed in the uniformed force of the New York city department of\nsanitation, and who is not eligible for early service retirement\npursuant to subdivision c of section six hundred four-a of this article,\nshall be eligible to receive the service retirement benefit specified in\nsection six hundred four of this article upon attainment of at least\nfifty-five years of age and the completion of thirty or more years of\nservice.\n * NB There are 2 sb b's\n c. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five or\nmore years of creditable service, without regard to age, who are\nemployed in Suffolk county as a correction officer as defined in section\neighty-nine-f of this chapter if: (i) such members have met the minimum\nservice requirements upon retirement, and (ii) in the case of a member\nsubject to the provisions of article fourteen of this chapter, such\nmember files an election therefor which provides that he or she will be\nsubject to the provisions of this article and to none of the provisions\nof such article fourteen. Such election, which shall be irrevocable,\nshall be in writing, duly executed and shall be filed with the\ncomptroller on or before September first, nineteen hundred eighty-nine\nor within one year after entering into employment with Suffolk county as\na corrections officer, as defined in section eighty-nine-f of this\nchapter, whichever is later. For the purposes of this subdivision, the\nterm "creditable service" shall have the meaning as so defined in both\nsections eighty-nine-f and six hundred one of this chapter.\n d. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are employed in Nassau\ncounty as a correction officer, uniformed correction division personnel,\nsheriff, undersheriff or deputy sheriff, as defined in section\neighty-nine-g of this chapter, if: (i) such members have met the minimum\nservice requirements upon retirement, and (ii) in the case of a member\nsubject to the provisions of article fourteen of this chapter, such\nmember files an election therefor which provides that he or she will be\nsubject to the provisions of this article and to none of the provisions\nof such article fourteen. Such election, which shall be irrevocable,\nshall be in writing, duly executed and shall be filed with the\ncomptroller on or before January first, nineteen hundred ninety-two. For\nthe purposes of this subdivision, the term "creditable service" shall\nhave the meaning as so defined in both sections eighty-nine-g and six\nhundred one of this chapter.\n e. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are employed in Albany\ncounty as a sheriff, undersheriff, deputy sheriff, correction officer or\nidentification officer as defined in section eighty-nine-h of this\nchapter if: (i) such members have met the minimum service requirements\nupon retirement, and (ii) in the case of a member subject to the\nprovisions of article fourteen of this chapter, such member files an\nelection therefor which provides that he or she will be subject to the\nprovisions of this article and to none of the provisions of such article\nfourteen. Such election, which shall be irrevocable, shall be in\nwriting, duly executed and shall be filed with the comptroller on or\nbefore December thirty-first, two thousand four. For the purposes of\nthis subdivision, the term "creditable service" shall have the meaning\nas so defined in both sections eighty-nine-h and six hundred one of this\nchapter.\n f. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are employed in St.\nLawrence county as a sheriff, undersheriff, deputy sheriff or correction\nofficer as defined in section eighty-nine-i of this chapter if: (i) such\nmembers have met the minimum service requirements upon retirement, and\n(ii) in the case of a member subject to the provisions of article\nfourteen of this chapter, such member files an election therefor which\nprovides that he or she will be subject to the provisions of this\narticle and to none of the provisions of such article fourteen. Such\nelection, which shall be irrevocable, shall be in writing, duly executed\nand shall be filed with the comptroller on or before December\nthirty-first, nineteen hundred ninety. For the purposes of this\nsubdivision, the term "creditable service" shall have the meaning as so\ndefined in both sections eighty-nine-i and six hundred one of this\nchapter.\n * g. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are employed in\nOrleans county as a sheriff, undersheriff, deputy sheriff or correction\nofficer as defined in section eighty-nine-l of this chapter if: (i) such\nmembers have met the minimum service requirements upon retirement, and\n(ii) in the case of a member subject to the provisions of article\nfourteen of this chapter, such member files an election therefor which\nprovides that he or she will be subject to the provisions of this\narticle and to none of the provisions of such article fourteen. Such\nelection, which shall be irrevocable, shall be in writing, duly executed\nand shall be filed with the comptroller on or before December\nthirty-first, nineteen hundred ninety-one, or within one year after\nentering into employment with Orleans county as a sheriff, undersheriff,\ndeputy sheriff or correction officer as defined in section eighty-nine-l\nof this chapter. For the purposes of this subdivision, the term\n"creditable service" shall have the meaning as so defined in both\nsections eighty-nine-l and six hundred one of this chapter.\n * NB There are 2 sb g's\n * g. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are employed in\nOnondaga county as a deputy sheriff-jail division competitively\nappointed or as a correction officer as defined in section eighty-nine-k\nof this chapter if: (i) such members have met the minimum service\nrequirements upon retirement, and (ii) in the case of a member subject\nto the provisions of article fourteen of this chapter, such member files\nan election therefor which provides that he or she will be subject to\nthe provisions of this article and to none of the provisions of such\narticle fourteen. Such election, which shall be irrevocable, shall be in\nwriting, duly executed and shall be filed with the comptroller on or\nbefore December thirty-first, nineteen hundred ninety-one, or within one\nyear after entering into employment with Onondaga county as a deputy\nsheriff-jail division competitively appointed or as a correction officer\nas defined in section eighty-nine-k of this chapter. For the purposes of\nthis subdivision, the term "creditable service" shall have the meaning\nas so defined in both sections eighty-nine-k and six hundred one of this\nchapter.\n * NB There are 2 sb g's\n * h. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are employed in\nJefferson county as a sheriff, undersheriff, deputy sheriff or\ncorrection officer as defined in section eighty-nine-j of this chapter\nif: (i) such members have met the minimum service requirements upon\nretirement, and (ii) in the case of a member subject to the provisions\nof article fourteen of this chapter, such member files an election\ntherefor which provides that he or she will be subject to the provisions\nof this article and to none of the provisions of such article fourteen.\nSuch election, which shall be irrevocable, shall be in writing, duly\nexecuted and shall be filed with the comptroller on or before December\nthirty-first, nineteen hundred ninety-two, or within one year after\nentering into employment with Jefferson county as a sheriff,\nundersheriff, deputy sheriff or correction officer as defined in section\neighty-nine of this chapter. For the purposes of this subdivision, the\nterm "creditable service" shall have the meaning as so defined in both\nsections eighty-nine-j and six hundred one of this chapter.\n * NB There are 2 sb h's\n * h. 1. The service retirement benefit specified in section six\nhundred four of this article shall be payable to members with\ntwenty-five years of creditable service, without regard to age, who are\nengaged directly in criminal law enforcement activities and who are\nemployed in the office of the district attorney of Westchester county as\na chief criminal investigator, deputy chief criminal investigator,\ncriminal investigator, senior criminal investigator, confidential\ncriminal investigator, assistant criminal investigator or criminal\ninvestigator/arson if: (i) such members have met the minimum service\nrequirements upon retirement, and (ii) in the case of a member subject\nto the provisions of article fourteen of this chapter, such member files\nan election therefor which provides that he or she will be subject to\nthe provisions of this article and to none of the provisions of article\nfourteen of this chapter. Such election, which shall be irrevocable,\nshall be in writing, duly executed and shall be filed with the\ncomptroller on or before December thirty-first, nineteen hundred\nninety-one, or within one year after entering employment in the office\nof the district attorney of Westchester county in one of the titles\naforementioned in this subdivision. For the purposes of this\nsubdivision, the term "creditable service" shall have the meaning as so\ndefined in both sections six hundred one and eighty-nine-d of this\nchapter and such term shall, subject to the conditions in such sections\nsix hundred one and eighty-nine-d, also include service as a chief\ncriminal investigator or a deputy chief criminal investigator.\n 2. Notwithstanding the provisions of paragraph one of this\nsubdivision, if the county of Westchester elects to provide the\nretirement benefit pursuant to this paragraph by adopting a resolution\nto such effect and filing a certified copy thereof with the comptroller,\nthe service retirement benefit specified in section six hundred four of\nthis article shall be payable to members with twenty years of creditable\nservice, without regard to age, who are engaged directly in criminal law\nenforcement activities and who are employed in the office of the\ndistrict attorney of Westchester county as a chief criminal\ninvestigator, deputy chief criminal investigator, criminal investigator,\nsenior criminal investigator, confidential criminal investigator,\nassistant criminal investigator or criminal investigator/arson if: (i)\nsuch members have met the minimum service requirements upon retirement,\nand (ii) in the case of a member subject to the provisions of article\nfourteen of this chapter, such member files an election therefor which\nprovides that he or she will be subject to the provisions of this\narticle and to none of the provisions of article fourteen of this\nchapter. Such election, which shall be irrevocable, shall be in writing,\nduly executed and shall be filed with the comptroller on or before\nDecember thirty-first, two thousand two, or within three years after\nentering employment in the office of the district attorney of\nWestchester county in one of the titles aforementioned in this\nparagraph.\n * NB There are 2 sb h's\n * i. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are employed in Broome\ncounty as a sheriff, undersheriff, deputy sheriff or correction officer\nas defined in section eighty-nine-m of this chapter if: (i) such members\nhave met the minimum service requirements upon retirement, and (ii) in\nthe case of a member subject to the provisions of article fourteen of\nthis chapter, such member files an election therefor which provides that\nhe or she will be subject to the provisions of this article and to none\nof the provisions of such article fourteen. Such election, which shall\nbe irrevocable, shall be in writing, duly executed and shall be filed\nwith the comptroller on or before December thirty-first, nineteen\nhundred ninety-one or within one year after entering into employment\nwith Broome county as a sheriff, undersheriff, deputy sheriff or\ncorrection officer. For the purposes of this subdivision, the term\n"creditable service" shall have the meaning as so defined in both\nsections eighty-nine-m and six hundred one of this chapter.\n * NB There are 2 sb i's\n * i. 1. A member of a teachers' retirement system or the New York\nstate and local employees' retirement system who has met the minimum\nservice requirements but who has less than thirty years of credited\nservice or a member who first joins the New York state and local\nemployees' retirement system or the New York state teachers' retirement\nsystem on or after January first, two thousand ten may retire prior to\nnormal retirement age, but no earlier than attainment of age fifty-five,\nin which event, unless such person is a member of the New York city\nteachers' retirement system who is otherwise eligible for early service\nretirement pursuant to subdivision c of section six hundred four-i of\nthis article, the amount of his or her retirement benefit otherwise\ncomputed without optional modification shall be reduced in accordance\nwith the following schedule:\n (i) for each of the first twenty-four full months that retirement\npredates age sixty-two, one-half of one per centum per month; provided,\nhowever, that for members who first join the New York state and local\nemployees' retirement system or the New York state teachers' retirement\nsystem on or after January first, two thousand ten, such amounts shall\nbe equal to one-fifteenth per year; and\n (ii) for each full month that retirement predates age sixty,\none-quarter of one per centum per month; provided, however, that for\nmembers who first join the New York state and local employees'\nretirement system or the New York state teachers' retirement system on\nor after January first, two thousand ten, such amounts shall be equal to\none-twentieth per year, but in no event shall retirement be permitted\nprior to attainment of age fifty-five.\n 2. A member of the New York city employees' retirement system or the\nboard of education retirement system of the city of New York who has met\nthe minimum service requirement, but who is not (a) a participant in the\ntwenty-five-year early retirement program, as defined in paragraph ten\nof subdivision a of section six hundred four-c of this article (as added\nby chapter ninety-six of the laws of nineteen hundred ninety-five), or\n(b) a participant in the age fifty-seven retirement program, as defined\nin paragraph three of subdivision b of section six hundred four-d of\nthis article, or (c) a New York city transit authority member, as\ndefined in paragraph one of subdivision a of section six hundred four-b\nof this article, may retire prior to normal retirement age, but no\nearlier than attainment of age fifty-five, in which event, unless such\nperson is a member of the board of education retirement system of such\ncity who is otherwise eligible for early service retirement pursuant to\nsubdivision c of section six hundred four-i of this article, the amount\nof his or her retirement benefit computed without optional modification\nshall be reduced in accordance with the following schedule:\n (i) for each of the first twenty-four full months that retirement\npredates age sixty-two, one-half of one per centum per month; and\n (ii) for each full month that retirement predates age sixty,\none-quarter of one per centum per month, but in no event shall\nretirement be permitted prior to attainment of age fifty-five.\n 3. A member of a public retirement system of the state who has met the\nminimum service requirement, but who is not a New York city transit\nauthority member, as defined in paragraph one of subdivision a of\nsection six hundred four-b of this article, may retire prior to normal\nretirement age, but no earlier than attainment of age fifty-five, in\nwhich event, the amount of his or her retirement benefit computed\nwithout optional modification shall be reduced by six and one-half per\ncentum for each year by which early retirement precedes age sixty-three.\n * NB There are 2 sb i's\n * j. Notwithstanding the other subdivisions of this section, any\nindividual who is subject to the provisions of article fourteen of this\nchapter who is entitled to receive benefits pursuant to section six\nhundred four of this article upon attaining the minimum service\nrequirements upon retirement and upon filing an irrevocable election\ntherefor which provides that he or she will be subject to the provisions\nof this article and to none of the provisions of such article fourteen,\nmay file such an election with the comptroller on or before the\napplicable date provided in this section or within one year after\nentering the employment upon which eligibility is based, whichever\noccurs later.\n * NB There are 2 sb j's\n * j. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are Monroe county\ndeputy sheriff-court security, or deputy sheriffs-jailors as defined in\nsection eighty-nine-n of this chapter if: (i) such members have met the\nminimum service requirements upon retirement, and (ii) in the case of a\nmember subject to the provisions of article fourteen of this chapter,\nsuch member files an election therefor which provides that he or she\nwill be subject to the provisions of this article and to none of the\nprovisions of such article fourteen. Such election, which shall be\nirrevocable, shall be in writing, duly executed and shall be filed with\nthe comptroller on or before September first, two thousand three or\nwithin one year after entering into employment with Monroe county as a\ndeputy sheriff-court security, or deputy sheriff-jailor. For the\npurposes of this subdivision, the term "creditable service" shall have\nthe meaning as so defined in both sections eighty-nine-n and six hundred\none of this chapter.\n * NB There are 2 sb j's\n k. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are employed in Greene\ncounty as a sheriff, undersheriff, deputy sheriff or correction officer\nas defined in section eighty-nine-o of this chapter if: (i) such members\nhave met the minimum service requirements upon retirement, and (ii) in\nthe case of a member subject to the provisions of article fourteen of\nthis chapter, such member files an election therefor which provides that\nhe or she will be subject to the provisions of this article and to none\nof the provisions of such article fourteen. Such election, which shall\nbe irrevocable, shall be in writing, duly executed and shall be filed\nwith the comptroller on or before December thirty-first, nineteen\nhundred ninety-four. For the purposes of this subdivision, the term\n"creditable service" shall have the meaning as so defined in both\nsections eighty-nine-o and six hundred one of this chapter.\n l. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are employed in a\ncounty which makes an election under subdivision j of section\neighty-nine-p of this chapter as a sheriff, undersheriff, deputy sheriff\nor correction officer as defined in section eighty-nine-p of this\nchapter if: (i) such members have met the minimum service requirements\nupon retirement, and (ii) in the case of a member subject to the\nprovisions of article fourteen of this chapter, such member files an\nelection therefor which provides that he or she will be subject to the\nprovisions of this article and to none of the provisions of such article\nfourteen. Such election, which shall be irrevocable, shall be in\nwriting, duly executed and shall be filed with the comptroller within\none year of an election his or her employer makes or within one year\nafter entering the employment with such county upon which eligibility is\nbased, whichever comes later. For the purposes of this subdivision, the\nterm "creditable service" shall have the meaning as so defined in both\nsections eighty-nine-p and six hundred one of this chapter.\n m. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are traffic officers\nwith the town of Elmira as defined in section eighty-nine-q of this\nchapter if: (i) such members have met the minimum service requirements\nupon retirement, and (ii) in the case of a member subject to the\nprovisions of article fourteen of this chapter, such member files an\nelection therefor which provides that he or she will be subject to the\nprovisions of this article and to none of the provisions of such article\nfourteen. Such election, which shall be irrevocable, shall be in\nwriting, duly executed and shall be filed with the comptroller on or\nbefore September first, nineteen hundred ninety-six. For the purposes of\nthis subdivision, the term "creditable service" shall have the meaning\nas so defined in both sections eighty-nine-q and six hundred one of this\nchapter.\n n. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five or\nmore years of creditable service, without regard to age, who are\nemployed by Suffolk county as a park police officer as defined in\nsection eighty-nine-r of this chapter if: (i) such members have met the\nminimum service requirements upon retirement, and (ii) in the case of a\nmember subject to the provisions of article fourteen of this chapter,\nsuch member files an election therefor which provides that he or she\nwill be subject to the provisions of this article and to none of the\nprovisions of such article fourteen. Such election, which shall be\nirrevocable, shall be in writing, duly executed and shall be filed with\nthe comptroller on or before September first, nineteen hundred\nninety-seven. For the purposes of this subdivision, the term\n"creditable service" shall have the meaning as so defined in both\nsections eighty-nine-r and six hundred one of this chapter.\n * o. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five or\nmore years of creditable service, who are employed as peace officers\nwithin the Suffolk county probation department, as defined in section\neighty-nine-s of this chapter if: (i) such members have met the minimum\nservice requirements upon retirement, and (ii) in the case of a member\nsubject to the provisions of article fourteen of this chapter, such\nmember files an election therefor which provides that he or she will be\nsubject to the provisions of this article and to none of the provisions\nof such article fourteen. Such election, which shall be irrevocable,\nshall be in writing, duly executed and shall be filed with the\ncomptroller on or before December thirty-first, nineteen hundred\nninety-eight or within one year of entering into service as a peace\nofficer with the Suffolk county probation department. For the purposes\nof this subdivision, the term "creditable service" shall have the\nmeaning as so defined in both sections eighty-nine-s and six hundred one\nof this chapter.\n * NB There are 4 sb o's\n * o. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five or\nmore years of creditable service, without regard to age, who are\nemployed as ambulance medical technicians, ambulance medical\ntechnician/supervisors or a member who performs ambulance medical\ntechnician related services, or a police medic, police medic supervisor\nor a member who performs police medic related services within the Nassau\ncounty police department, as defined in section eighty-nine-s of this\nchapter if: (i) such members have met the minimum service requirements\nupon retirement, and (ii) in the case of a member subject to the\nprovisions of article fourteen of this chapter, such member files an\nelection therefor which provides that he or she will be subject to the\nprovisions of this article and to none of the provisions of such article\nfourteen. Such election, which shall be irrevocable, shall be in\nwriting, duly executed and shall be filed with the comptroller on or\nbefore January first, two thousand. For the purposes of this\nsubdivision, the term "creditable service" shall have the meaning as so\ndefined in both sections eighty-nine-s and six hundred one of this\nchapter.\n * NB There are 4 sb o's\n * o. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five or\nmore years of creditable service, without regard to age, who are\nemployed as peace officers within the Nassau county probation\ndepartment, as defined in section eighty-nine-s of this chapter if: (i)\nsuch members have met the minimum service requirements upon retirement,\nand (ii) in the case of a member subject to the provisions of article\nfourteen of this chapter, such member files an election therefor which\nprovides that he or she will be subject to the provisions of this\narticle and to none of the provisions of such article fourteen. Such\nelection, which shall be irrevocable, shall be in writing, duly executed\nand shall be filed with the comptroller on or before December\nthirty-first, nineteen hundred ninety-nine or within one year of\nentering into service as a peace officer with the Nassau county\nprobation department. Peace officers within the Nassau county probation\ndepartment must serve five years after the effective date of this\nsubdivision before they are eligible to retire under the provisions of\nthe twenty-five year retirement plan. For the purposes of this\nsubdivision, the term "creditable service" shall have the meaning as so\ndefined in both sections eighty-nine-s and six hundred one of this\nchapter.\n * NB There are 4 sb o's\n * o. The county of Rockland may elect to provide the service\nretirement benefit specified in section six hundred four of this article\nfor members with twenty years of creditable service, without regard to\nage, who are engaged directly in criminal law enforcement activities and\nwho are employed in the office of the district attorney of Rockland\ncounty as a chief investigator/detective, criminal\ninvestigator-electronics, criminal investigator-child abuse, senior\ncriminal investigator or criminal investigator if: (i) such members have\nmet the minimum service requirements upon retirement, and (ii) in the\ncase of a member subject to the provisions of article fourteen of this\nchapter, such members file an election thereof which provides that he or\nshe will be subject to the provisions of this article and to none of the\nprovisions of article fourteen of this chapter. Such election, which\nshall be irrevocable, shall be in writing, duly executed and shall be\nfiled with the comptroller within one year of the adoption of the\nresolution by the county of Rockland pursuant to this section or within\none year after entering employment in the office of the district\nattorney of Rockland county in one of the titles aforementioned in this\nsubdivision, whichever is later. If the county of Rockland elects to\nprovide the retirement benefit pursuant to this subdivision, they shall\nadopt a resolution to such effect and file a certified copy thereof with\nthe comptroller. For the purposes of this subdivision, the term\n"creditable service" shall have the meaning as so defined in both\nsections eighty-nine-d and six hundred one of this chapter and such term\nshall, subject to the conditions in such sections eighty-nine-d and six\nhundred one, also include service as a chief investigator/detective,\ncriminal investigator-electronics or a criminal investigator-child\nabuse.\n * NB There are 4 sb o's\n * p. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are employed in a\ncounty which makes an election under subdivision j of section\neighty-nine-t of this chapter as a peace officer as defined in section\neighty-nine-t of this chapter if: (i) such members have met the minimum\nservice requirements upon retirement, and (ii) in the case of a member\nsubject to the provisions of article fourteen of this chapter, such\nmember files an election therefor which provides that he or she will be\nsubject to the provisions of this article and to none of the provisions\nof such article fourteen. Such election, which shall be irrevocable,\nshall be in writing, duly executed and shall be filed with the\ncomptroller within one year of an election his or her employer makes or\nwithin one year after entering the employment with such county upon\nwhich eligibility is based, whichever comes later. For the purposes of\nthis subdivision, the term "creditable service" shall have the meaning\nas so defined in both sections eighty-nine-t and six hundred one of this\nchapter.\n * NB There are 2 sb p's\n * p. The service retirement benefit specified in section six hundred\nfour of this article shall be payable without regard to age to\nqualifying members, as defined in subdivision a of section eighty-nine-t\nof this chapter, with twenty-five years of qualifying service as defined\nin such section, if such members have met the minimum service\nrequirements upon retirement. Any such member shall be entitled to\nretire after the completion of twenty-five years of qualifying\ncreditable service by filing an application therefor in a manner similar\nto that provided in section seventy of this chapter.\n * NB There are 2 sb p's\n q. The county of Suffolk may elect to provide the service retirement\nspecified in section six hundred four of this article for members with\ntwenty years of creditable service, without regard to age, who are\nengaged directly in criminal law enforcement activities and who are\nemployed in the office of the district attorney of Suffolk county as a\ndetective investigator, senior detective investigator, principal\ndetective investigator, special investigator, or district attorney\ninvestigator if: (i) such members have met the minimum service\nrequirements upon retirement, and (ii) in the case of a member subject\nto the provisions of article fourteen of this chapter, such members file\nan election thereof which provides that he or she will be subject to the\nprovisions of this article and to none of the provisions of article\nfourteen of this chapter. Such election, which shall be irrevocable,\nshall be in writing, duly executed and shall be filed with the\ncomptroller within one year of the adoption of the resolution by the\ncounty of Suffolk pursuant to this section or within one year after\nentering employment in the office of the district attorney of Suffolk\ncounty in one of the titles aforementioned in this subdivision,\nwhichever is later. If the county of Suffolk elects to provide the\nretirement benefit pursuant to this subdivision, it shall adopt a\nresolution to such effect and file a certified copy thereof with the\ncomptroller. For the purposes and effect of this subdivision, the term\n"creditable service" shall have the meaning as so defined in both\nsections eighty-nine-d and six hundred one of this chapter and such term\nshall, subject to the conditions in such sections eight-nine-d and six\nhundred one, also include service as a detective investigator, senior\ndetective investigator, principal detective investigator, special\ninvestigator, or district attorney investigator.\n * r. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are with the town of\nTonawanda as defined in section eighty-nine-v of this chapter if: (i)\nsuch members have met the minimum service requirements upon retirement,\nand (ii) in the case of a member subject to the provisions of article\nfourteen of this chapter, such member files an election therefor which\nprovides that he or she will be subject to the provisions of this\narticle and to none of the provisions of such article fourteen. Such\nelection, which shall be irrevocable, shall be in writing, duly executed\nand shall be filed with the comptroller within one year following the\neffective date of this subdivision or one year following commencement of\nemployment as a paramedic employed by the police department in the town\nof Tonawanda, whichever is later. For the purposes of this subdivision,\nthe term "creditable service" shall have the meaning as so defined in\nboth sections eighty-nine-v and six hundred one of this chapter.\n * NB There are 3 sb r's\n * r. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five or\nmore years of creditable service, without regard to age, who are\nemployed as deputy sheriffs-civil in Rockland county, as defined in\nsection eighty-nine-v of this chapter if: (i) such members have met the\nminimum service requirements upon retirement, and (ii) in the case of a\nmember subject to the provisions of article fourteen of this chapter,\nsuch member files an election therefor which provides that he or she\nwill be subject to the provisions of this article and to none of the\nprovisions of such article fourteen. Such election, which shall be\nirrevocable, shall be in writing, duly executed and shall be filed with\nthe comptroller on or before December thirty-first, two thousand one or\nwithin one year of entering into service as a deputy sheriff-civil in\nRockland county. The term "creditable service" shall have the meaning as\nso defined in section eighty-nine-t, as added by chapter 603 of the laws\nof 1998 and section six hundred one of this chapter.\n * NB There are 3 sb r's\n * r. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are employed in\nRockland county as a correction officer as defined in section\neighty-nine-v of this chapter if: (i) such members have met the minimum\nservice requirements upon retirement, and (ii) in the case of a member\nsubject to the provisions of article fourteen of this chapter, such\nmember files an election therefor which provides that he or she will be\nsubject to the provisions of this article and to none of the provisions\nof such article fourteen. Such election, which shall be irrevocable,\nshall be in writing, duly executed and shall be filed with the\ncomptroller on or before December thirty-first, two thousand one. For\nthe purposes of this subdivision, the term "creditable service" shall\nhave the meaning as so defined in both sections eighty-nine-v and six\nhundred one of this chapter.\n * NB There are 3 sb r's\n s. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are employed in the\ncounty of Nassau as a county fire marshal, supervising fire marshal,\nfire marshal, assistant fire marshal, assistant chief fire marshal,\nchief fire marshal or division supervising fire marshal as defined in\nsection eighty-nine-w of this chapter if: (i) such members have met the\nminimum service requirements upon retirement, and (ii) in the case of a\nmember subject to the provisions of article fourteen of this chapter,\nsuch member files an election therefor which provides that he or she\nwill be subject to the provisions of this article and to none of the\nprovisions of such article fourteen. Such election, which shall be\nirrevocable, shall be in writing, duly executed and shall be filed with\nthe comptroller within one year of the effective date of this\nsubdivision or within one year after entering the employment with such\ncounty upon which eligibility is based, whichever comes later. For the\npurposes of this subdivision, the term "creditable service" shall have\nthe meaning as so defined in both sections eighty-nine-w and six hundred\none of this chapter.\n t. Members who join the New York state teachers' retirement system on\nor after January first, two thousand ten, shall be eligible to retire\nwithout reduction of his or her retirement benefit upon attainment of at\nleast fifty-seven years of age and completion of thirty or more years of\nservice. Members who retire pursuant to the provisions of this\nsubdivision shall be required to make the member contributions required\nby subdivision g of section six hundred thirteen of this article for all\nyears of credited and creditable service. The provisions of this\nsubdivision shall not apply to members who first become a member of the\nNew York state teachers' retirement system on or after April first, two\nthousand twelve.\n u. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five or\nmore years of creditable service, without regard to age, who are\nemployed as deputy sheriffs-civil in Monroe county, as defined in\nsection eighty-nine-x of this chapter if: (i) such members have met the\nminimum service requirements upon retirement, and (ii) in the case of a\nmember subject to the provisions of article fourteen of this chapter,\nsuch member files an election therefor which provides that he or she\nwill be subject to the provisions of this article and to none of the\nprovisions of such article fourteen. Such election, which shall be\nirrevocable, shall be in writing, duly executed and shall be filed with\nthe comptroller on or before December thirty-first, two thousand\ntwenty-four or within one year of entering into service as a deputy\nsheriff-civil in Monroe county. The term "creditable service" shall have\nthe meaning as so defined in section eighty-nine-x and subdivision c of\nsection six hundred one of this chapter.\n v. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are employed by a\nparticipating fire district that makes the election provided for in\nsubdivision j of section eighty-nine-ss of this chapter as an emergency\nmedical technician, critical care technician, advanced emergency medical\ntechnician, paramedic or supervisor of such titles in a participating\nSuffolk county fire district as defined in section eighty-nine-ss of\nthis chapter if: (i) such members have met the minimum service\nrequirements upon retirement; and (ii) in the case of a member subject\nto the provisions of article fourteen of this chapter, such member files\nan election therefor which provides that such member will be subject to\nthe provisions of this article and to none of the provisions of such\narticle fourteen. Such election, which shall be irrevocable, shall be in\nwriting, duly executed and shall be filed with the comptroller within\none year of the election such member's employer makes pursuant to\nsubdivision j of section eighty-nine-ss or within one year after\nentering the employment with the participating Suffolk county fire\ndistrict upon which eligibility is based, whichever comes later. For the\npurposes of this subdivision, the term "creditable service" shall have\nthe meaning as so defined in both sections eighty-nine-ss and six\nhundred one of this chapter.\n w. The service retirement benefit specified in section six hundred\nfour of this article shall be payable to members with twenty-five years\nof creditable service, without regard to age, who are employed by the\ndivision of military and naval affairs as a firefighter apprentice,\nairport firefighter I, airport firefighter II, airport firefighter III,\nor training and safety officer as defined in section eighty-nine-y of\nthis chapter if: (i) such members have met the minimum service\nrequirements upon retirement; and (ii) in the case of a member subject\nto the provisions of article fourteen of this chapter, such member files\nan election therefor which provides that they will be subject to the\nprovisions of this article and to none of the provisions of such article\nfourteen. Such election, which shall be irrevocable, shall be in\nwriting, duly executed and shall be filed with the comptroller within\none year of the effective date of this subdivision or within one year\nafter entering the employment with the division of military and naval\naffairs upon which eligibility is based, whichever comes later. For the\npurposes of this subdivision, the term "creditable service" shall have\nthe meaning as so defined in both sections eighty-nine-y and six hundred\none of this chapter.\n
