§ 77-B — Speedometers on certain locomotives

§ 77-b. Speedometers on certain locomotives. (a) No railroad\nlocomotive may be operated in excess of thirty miles per hour within the\nstate without a speedometer functioning correctly within four miles per\nhour.\n (b) A railroad shall be deemed to be in compliance with the above\nprovisions if within one year after the first day of October next\nsucceeding the date on which this statute shall have become a law, it\nshall have at least one-third of its locomotives equipped with a\nspeedometer as hereinabove provided; and if within the following year an\nadditional one-third of said locomotives shall be so equipped and the\nremainder of said locomotives so operated by a railroad shall be in\ncompliance with the provisions of this statute within one year\nthereafter.\n (c) Locomotives operated or used exclusively in switching or transfer\nservice and multiple unit cars shall be exempted from the above\nprovisions.\n (d) Each such railroad shall notify the department of transportation\nof the state of New York the date that each such locomotive shall be in\ncompliance with the provisions of this statute, stating the serial\nnumber or other identification of each such locomotive.\n (e) Each railroad affected or covered by the provisions of this\nstatute shall maintain at a designated location in this state a list or\nschedule of the locomotives hereinabove referred to, setting forth,\namong other information, the date that the speedometer hereinbefore\nreferred to shall have been calibrated and functioning in accordance\nwith the provisions of this statute.\n (f) The commissioner of transportation of the state of New York shall\nenforce the provisions of this statute and may issue such order or\norders as may be proper to require compliance with the provisions of\nthis statute.\n
