§ 3004. Emergency medical services system and agency performance\nstandards. 1. The state emergency medical services council and with\ninput from the regional emergency medical services councils, in\ncollaboration and with final approval of the department, shall create an\nemergency medical services system and agency performance standards\n(hereinafter referred to as "performance standards") for the purpose of\nsustaining and evolving a reliable emergency medical services system\nincluding but not limited to emergency medical services agencies and any\nfacility or agency that dispatches or accepts emergency medical services\nresources.\n 2. The performance standards may include but shall not be limited to:\nsafety initiatives, emergency vehicle operations, operational\ncompetencies, planning, training, onboarding, workforce development and\nengagement, survey responses, leadership and other standards and metrics\nas determined by the state emergency medical services council, with\napproval of the department, to promote positive patient outcomes,\nsafety, provider retention and emergency medical services system\nsustainability throughout the state.\n 3. The performance standards shall require each emergency medical\nservices agency, dispatch agency or facility that accepts emergency\nmedical services resources to perform regular and periodic review of the\nperformance standards and its metrics, perform surveys, identification\nof agency deficiencies and strengths, development of programs to improve\nagency metrics, strengthen system sustainability and operations, and\nimprove the delivery of patient care.\n 4. The department, after consultation with the state emergency medical\nservices council and with input from regional emergency medical services\ncouncils, may contract for services with subject matter experts to\nassist in the oversight of the performance standards statewide.\n 5. Emergency medical services agencies that do not meet the\nperformance standards set forth in this section may be subject to\nenforcement actions, including but not limited to revocation,\nsuspension, performance improvement plans, or restriction from specific\ntypes of response including but not limited to suspension of ability to\nrespond to requests for emergency medical assistance or to perform\nemergency medical services.\n
