§ 1399-kk. Annual tobacco and vapor product enforcement reporting. The\ncommissioner shall submit to the governor and the legislature an interim\ntobacco control report and annual tobacco control reports which shall\ndescribe the extent of the use of tobacco products and vapor products,\nintended or reasonably expected to be used with or for the consumption\nof nicotine, by those under twenty-one years of age in the state and\ndocument the progress state and local governments have made in reducing\nsuch use among those under twenty-one years of age.\n 1. Such interim\nreport shall, to the extent practicable, include the following\ninformation on a county by county basis:\n (a) number of licensed and registered tobacco retailers and vendors;\n (b) the names and addresses of retailers and vendors who have paid\nfines, or have been otherwise penalized, due to enforcement actions;\n (c) the number of complaints filed against licensed and registered\ntobacco retailers;\n (d) the number of fires caused or believed to be caused by tobacco\nproducts and deaths and injuries resulting therefrom;\n (e) the number and type of compliance checks conducted; and\n (f) such other information as the commissioner deems appropriate.\n 2. The commissioner shall submit to the governor and the legislature\nan annual tobacco and vapor products, intended or reasonably expected to\nbe used with or for the consumption of nicotine, control report which\nshall describe the extent of the use of tobacco products and vapor\nproducts, intended or reasonably expected to be used with or for the\nconsumption of nicotine, by those under twenty-one years of age in the\nstate and document the progress state and local governments have made in\nreducing such use among those under twenty-one years of age. The annual\nreport shall be submitted to the governor and the legislature on or\nbefore March thirty-first of each year beginning on March thirty-first,\nnineteen hundred ninety-nine. The annual report shall, to the extent\npracticable, include the following information on a county by county\nbasis:\n (a) number of licensed and registered tobacco retailers and vendors\nand licensed vapor products dealers;\n (b) the names and addresses of retailers and vendors who have paid\nfines, or have been otherwise penalized, due to enforcement actions;\n (c) the number of complaints filed against licensed and registered\ntobacco retailers and licensed vapor products dealers;\n (d) the number of fires caused or believed to be caused by tobacco\nproducts and vapor products, intended or reasonably expected to be used\nwith or for the consumption of nicotine, and deaths and injuries\nresulting therefrom;\n (e) the number and type of compliance checks conducted;\n (f) a survey of attitudes and behaviors regarding tobacco use among\nthose under twenty-one years of age. The initial such survey shall be\ndeemed to constitute the baseline survey;\n (g) the number of tobacco and vapor product, intended or reasonably\nexpected to be used with or for the consumption of nicotine, users and\nestimated trends in tobacco and vapor product, intended or reasonably\nexpected to be used with or for the consumption of nicotine, use among\nthose under twenty-one years of age;\n (h) annual tobacco and vapor product, intended or reasonably expected\nto be used with or for the consumption of nicotine, sales;\n (i) tax revenue collected from the sale of tobacco products and vapor\nproducts, intended or reasonably expected to be used with or for the\nconsumption of nicotine;\n (j) the number of licensed tobacco retail outlets and licensed vapor\nproducts dealers;\n (k) the number of cigarette vending machines;\n (l) the number and type of compliance checks;\n (m) the names of entities that have paid fines due to enforcement\nactions; and\n (n) the number of complaints filed against licensed tobacco retail\noutlets and licensed vapor products dealers.\n The annual tobacco and vapor product, intended or reasonably expected\nto be used with or for the consumption of nicotine, control report\nshall, to the extent practicable, include the following information: (a)\ntobacco and vapor product, intended or reasonably expected to be used\nwith or for the consumption of nicotine, control efforts sponsored by\nstate government agencies including money spent to educate those under\ntwenty-one years of age on the hazards of tobacco and vapor product,\nintended or reasonably expected to be used with or for the consumption\nof nicotine, use;\n (b) recommendations for improving tobacco and vapor product, intended\nor reasonably expected to be used with or for the consumption of\nnicotine, control efforts in the state; and\n (c) such other information as the commissioner deems appropriate.\n
