§ 1426 — Definitions

§ 1426. Definitions. As used or referred to in this title, unless a\ndifferent meaning clearly appears from the context:\n 1. The term "authority" shall mean the corporation created by section\none thousand four hundred twenty-seven of this title;\n 2. The term "city" shall mean the city of White Plains;\n 3. The term "bonds" shall mean the bonds authorized in this title;\n 4. The term "board" shall mean the members of the authority;\n 5. The term "real property" shall mean lands, structures, franchises,\nand interest in lands, and any and all things usually included within\nthe said term, and includes not only fees simple absolute but also any\nand all lesser interests, such as easements, rights of way, uses,\nleases, licenses, and all other incorporeal hereditaments and every\nestate, interest or right, legal or equitable, including terms of years,\nand liens thereon by way of judgments, mortgages or otherwise, and also\nclaims for damage to real estate;\n 6. The term "project" shall mean any area or place operated or to be\noperated for the parking or storing of motor and other vehicles and\nshall, without limiting the generality of the foregoing, include all\nreal and personal property, driveways, roads, approaches, structures,\nterminals of all kinds, garages, meters, machinery, apparatus and\nequipment, and all appurtenances and facilities either on, above or\nunder the ground which are determined to be necessary or convenient in\nconnection with the operation of any such area or place;\n 7. The term "projects" shall mean more than one project.\n 8. The term "bonds" shall mean bonds, notes or other obligations\nissued by the authority pursuant to this title;\n 9. The term "construction", as applied to any project, shall include\nthe erection, building, acquisition, alteration, reconstruction,\nimprovement, enlargement or extension thereof, as the case may be,\nincluding the inspection and supervision thereof, and the engineering,\narchitectural, legal, fiscal and economic investigations, studies,\nsurveys, designs, plans, working drawings, specifications, procedures\nand other actions incidental thereto;\n 10. The term "cost", as used with reference to any project or other\ncorporate purpose of the authority, shall include the cost of the\nconstruction, the cost of the acquisition of all property, including\nreal and personal property, improved or unimproved, and the cost of\ndemolishing, removing or relocating any buildings, structures or other\nimprovements on lands acquired for the project, the cost of all\nmachinery, apparatus and equipment, the cost of all appurtenances and\nincidental facilities, financing charges, interest prior to and during\nconstruction, the cost of engineering and architectural surveys, plans\nand specifications, the cost of legal and other professional services,\nthe cost of lease guarantee or bond insurance, other expenses necessary\nor incidental to the construction of the project and the financing\nthereof, including the amount authorized in the resolution of the\nauthority providing for the issuance of bonds to be paid into any\nreserve or other special fund from the proceeds of such bonds and the\nfinancing of the placing of the project in operation, including\nreimbursement to the city, any state agency, the state, the United\nStates government, or any other person, for expenditures made with the\nprior approval of the authority, that would be costs of the project\nhereunder had they been made directly by the authority;\n 11. The term "revenues" shall mean all rates, fees, rents, charges and\nall other income derived by the authority from its operations; and\n 12. The term "state" shall mean the state of New York.\n
