"Cost" as applied to any project, includes the cost of\nconstruction, the cost of the acquisition of all property, including\nreal property and other property, both real and personal and improved\nand unimproved, the cost of the demolishing, removing or relocating any\nbuildings or structures on lands so acquired, including the cost of\nacquiring any lands to which such buildings or structures may be moved\nor relocated, the cost of all systems, facilities, machines, apparatus\nand equipment, financing charges, interest prior to, during and after\nconstruction to the extent not paid or provided for from revenues or\nother sources, the cost of engineering and architectural surveys, plans\nand specifications, the cost of consultant and legal services, the cost\nof guarantee, bond insurance, other credit support device and the cost\nof other expenses necessary or incidental to the construction of such\nproject and the financing of the construction thereof, including the\namount authorized in the resolution of the authority providing for the\nissuance of bonds to be paid into any reserve or other special funds\nfrom the proceeds of such bonds and the financing of the placing of any\nproject in operation, including reimbursement to the county, or any\nmunicipality, state agency, the state, the United States government, or\nany other person for expenditures that would be costs of the project\nhereunder had they been made directly by the authority.\n 7. "County" means the county of Orange.\n 8. "County executive" means the county executive of the county.\n 9. "County legislature" means the county legislature of the county.\n 10. "District" means the Orange county water district created by\nsection one thousand one hundred ninety-nine-cc of this title.\n 11. "Distribution system" means the water facility or facilities\nemployed to deliver water from a transmission facility, or where there\nis no transmission facility, from a supply facility, to the ultimate\nconsumers of such water.\n 12. "Governing body" means the members of the authority constituting\nand acting as the governing body of the authority.\n 13. "Municipality" means any county, city, town, village, improvement\ndistrict under the town law, any other such instrumentality, including\nany agency, or public corporation of the state, or any of the foregoing\nor any combination thereof.\n 14. "Person" means any natural person, partnership, association, joint\nventure or corporation, exclusive of a public corporation.\n 15. "Project" means any water facility.\n 16. "Properties" means the water system or systems of the authority,\nwhether situated within or without the territorial limits of the\ndistrict, including the plants, works, structures, instrumentalities or\npart thereof and appurtenances thereto, real property, water facilities,\nor any other property incidental to and included in such system or\nsystems or part thereof, any improvements, extensions and betterments.\n 17. "Real property" means lands, structures, franchise, rights and\ninterests in land, waters, land under water, riparian rights and air\nrights and any and all things and rights included within said term and\nincludes not only fees simple absolute, but also any and all lesser\ninterests including, but not limited to, easements, rights-of-way, uses,\nleases, licenses and all other incorporeal hereditaments and every\nestate, interest or right, legal or equitable, including terms for years\nand liens thereon by way of judgments, mortgages or otherwise.\n 18. "Revenues" means all rates, fees, charges, payments and other\nincome and receipts derived from the operation of the properties of the\nauthority including, without limiting the generality of the foregoing,\ninvestment proceeds and proceeds of insurance, condemnation, and sale or\nother disposition of assets, together with all federal, state or\nmunicipal aid, if any.\n 19. "State" means the state of New York.\n 20. "State agency" means any state officer, public benefit\ncorporation, department, board, commission, bureau or division, or other\nagency or instrumentality of the state.\n 21. "Supply facility" means a water facility employed to make\ngroundwater, surface water or water to be purchased from the city of New\nYork, the New York city municipal water finance authority, New York city\nwater board or any agency or instrumentality thereof, available for\ndelivery into a transmission facility or distribution system.\n 22. "Transmission facility" means a water facility used to carry water\nfrom a supply facility to a distribution system.\n 23. "Water facility" or "water facilities" means any plants,\nstructures and other real and personal property acquired, rehabilitated\nor constructed or planned for the purpose of accumulating, supplying,\ntransmitting, treating or distributing water, including but not limited\nto surface or groundwater reservoirs, basins, dams, canals, aqueducts,\naqueduct taps, standpipes, conduits, pipelines, mains, pumping stations,\npumps, water distribution systems, compensating reservoirs, intake\nstations, waterworks or sources of water supply, wells, purification or\nfiltration plants or other treatment plants and works, contract rights,\nfranchises, approaches, connections, permits, water meters, rights of\nflowage or diversion and other plants, structures, equipment, vehicles,\nconveyances, real or personal property or rights therein and\nappurtenances thereto necessary or useful and convenient for the\naccumulation, supply, transmission, treatment or distribution of water.\n * NB There are 2 § 1199-bb's\n
