§ 33.01 New York state heritage areas advisory council. There shall\ncontinue to be in the office a New York state heritage areas advisory\ncouncil which shall consist of twenty-six members or their designated\nrepresentatives. The commissioner shall be a member of the advisory\ncouncil. In addition, the advisory council shall consist of the\nfollowing twenty-five other members: the commissioner of economic\ndevelopment, to advise and assist regarding related tourism and economic\nrevitalization; the commissioner of education, to advise and assist\nregarding the interpretive and educational aspects of the programs; the\nsecretary of state, to advise and assist regarding matters of community\ndevelopment and state planning and to advise on the identification and\npreservation of rural resources; the commissioner of transportation, to\nadvise and assist regarding matters of transportation to and within\nheritage areas; the president of the New York state urban development\ncorporation, to advise and assist regarding matters of economic\ndevelopment; the commissioner of environmental conservation, to advise\nand assist regarding matters of conservation and use of natural\nresources; the chairman of the state board for historic preservation, to\nadvise and assist in matters regarding historic preservation; the\ncommissioner of housing and community renewal to advise and assist\nregarding neighborhood and community development and preservation\nprograms; the president and chief executive officer of the power\nauthority of the state of New York regarding the operation of the New\nYork state canal system; the commissioner of agriculture and markets\nregarding agriculture in heritage areas; a representative of the State\nHeritage Area Association; the director or chief executive officer of\nthe Hudson River National Heritage Area, the Erie Canalway National\nHeritage Corridor, the Champlain Valley National Heritage Partnership\nand the Niagara Falls National Heritage Area; and ten members to be\nappointed by the governor, three of such members shall be municipal\nofficers, elected officials or representatives of local government\ninterest and seven of such members shall be, by professional training or\nexperience or attainment, qualified to analyze or interpret matters\nrelevant to the establishment and maintenance of state designated\nheritage areas including urban cultural parks and heritage corridors,\none of whom shall be the director of a heritage area. Of these last\nseven, two are to be appointed from names recommended by the majority\nleader of the senate, two are to be appointed from names recommended by\nthe speaker of the assembly, one is to be appointed from names\nrecommended by the minority leader of the senate and one is to be\nappointed from names recommended by the minority leader of the assembly.\nThe governor may designate such ex-officio members who shall be from the\nexecutive department, state agencies or public corporations as he or she\ndeems appropriate; provided that such ex-officio members shall not vote\non matters before the advisory council. For the ten members appointed by\nthe governor, each shall hold office for a term of five years and until\nhis or her successor shall have been appointed or until he or she shall\nresign. The members of the advisory council shall elect a chair from\namongst its members for a term of three years. Eleven members of the\nadvisory council shall constitute a quorum for the transaction of any\nbusiness at both regular and special meetings. Any ex-officio member may\ndelegate all his or her duties of membership, including voting rights,\nto an officer or employee of such member's organization. No member shall\nreceive any compensation.\n
