§ 46-b. Special provisions relating to speed on Saratoga lake. 1.\nNotwithstanding any other provisions of this chapter or any inconsistent\nlocal laws, every pleasure vessel operated on Saratoga lake, located in\nthe towns of Malta, Saratoga and Stillwater, and the city of Saratoga\nSprings, Saratoga county, shall be operated in a careful and prudent\nmanner, in such a way as to not unreasonably interfere with or endanger\nany vessel or person, and no vessel shall be operated at a speed\nexceeding forty-five miles per hour. No pleasure vessel operated on\nSaratoga lake shall be operated at a speed exceeding twenty-five miles\nper hour between one-half hour after sunset and one-half hour before\nsunrise.\n 2. Notwithstanding subdivision one of this section the five miles\nper hour speed zone at the state route nine-P state boat launch, in\neffect prior to the effective date of this section, shall remain in full\nforce and effect.\n 3. No vessel shall be operated on Saratoga lake within two hundred\nfeet of shore, a dock, pier, raft or float or an anchored or moored\nvessel in a manner or at such a speed that causes a wake that\nunreasonably interferes with or endangers such shoreline, dock, pier,\nraft or float or anchored or moored vessel, but in no event at a speed\nexceeding five miles per hour, unless for the purpose of enabling a\nperson engaged in water skiing to take off or land.\n 4. The provisions of this section shall not apply to any vessel\ncompeting in or practicing for a regatta or boat race over a specified\ncourse held by a bona fide club or racing association, provided that due\nwritten notice of the date of the race has been given to the appropriate\nlaw enforcement agencies at least fifteen days prior to such race,\npursuant to the provisions of section thirty-four of this chapter, and\nall provisions of such section have been complied with. The provisions\nof this section shall not apply to any federal aviation agency licensed\naircraft.\n 5. Any person who violates any provision of this section shall be\nguilty of a violation punishable as provided in section seventy-three-c\nof this article.\n
