§ 340. Special task force for the apparel industry. Definitions. As\nused in this article, the following terms shall have the following\nmeanings:\n (a) "Commissioner" shall mean the commissioner of labor;\n (b) "Department" shall mean the department of labor;\n (c) "Apparel industry" shall mean the making, cutting, sewing,\nfinishing, assembling, pressing or otherwise producing, by any of the\nforegoing apparel industry services, any men's, women's, children's or\ninfants' apparel, or a section or component of apparel, designed or\nintended to be worn by any individual which is to be sold or offered for\nsale, provided, however, that the apparel industry shall not include\ncleaning or tailoring after the apparel has been sold at retail;\n (d) "Manufacturer" shall mean any person who

As\nused in this article, the following terms shall have the following\nmeanings:\n (a) "Commissioner" shall mean the commissioner of labor;\n (b) "Department" shall mean the department of labor;\n (c) "Apparel industry" shall mean the making, cutting, sewing,\nfinishing, assembling, pressing or otherwise producing, by any of the\nforegoing apparel industry services, any men's, women's, children's or\ninfants' apparel, or a section or component of apparel, designed or\nintended to be worn by any individual which is to be sold or offered for\nsale, provided, however, that the apparel industry shall not include\ncleaning or tailoring after the apparel has been sold at retail;\n (d) "Manufacturer" shall mean any person who (i) in fulfillment or\nanticipation of a wholesale purchase contract, contracts with a\ncontractor to perform in New York state the cutting, sewing, finishing,\nassembling, pressing or otherwise producing any men's, women's,\nchildren's or infants' apparel, or a section or component of apparel,\ndesigned or intended to be worn by any individual which, pursuant to\nsuch contract, is to be sold or offered for sale to a retailer or other\nentity, or (ii) cuts, sews, finishes, assembles, presses or otherwise\nproduces in New York state any men's, women's, children's or infants'\napparel, or a section or component, designed or intended to be worn by\nany individual which is to be sold or offered for sale; provided,\nhowever, that "manufacturer" shall not mean a production employee\nemployed for wages who does not employ others;\n (e) "Contractor" shall mean any person who, in fulfillment of a\ncontract with a manufacturer, performs in New York state the cutting,\nsewing, finishing, assembling, pressing or otherwise producing any\nmen's, women's, children's or infants' apparel, or a section or\ncomponent of apparel, designed or intended to be worn by any individual\nwhich is to be sold or offered for sale. "Contractor" shall include, but\nnot be limited to, a subcontractor, jobber, or wholesaler, but shall not\ninclude a production employee who is employed for wages but does not\nemploy others;\n (f) "Production employees" shall mean persons who are employed by a\ncontractor or a manufacturer directly to perform the cutting, sewing,\nfinishing, assembling, pressing or otherwise producing of any men's,\nwomen's, children's or infants' apparel, or a section or component of\napparel, designed or intended to be worn by any individual which is to\nbe sold or offered for sale;\n (g) "Special task force" shall mean the special task force on the\napparel industry within the department; and\n (h) "Labor law" shall mean the labor law of New York state.\n (i) "Retailer" shall mean any mercantile enterprise which sells to\nconsumers or offers to sell to consumers any men's, women's, children's\nor infants' apparel, or a section or component of apparel, designed or\nintended to be worn by any individual consumer.\n
