§ 962. Empire zone development plan. An empire zone development plan\nshall be submitted for approval with the commissioner and with the local\nempire zone administrative board, and shall demonstrate the methods by\nwhich the applicant intends to promote the development of new business\nand the expansion of existing business within the empire zone and shall\ninclude, but shall not be limited to:\n (a) a statement indicating how empire zone designation would assist in\nthe revitalization of the area in which such zone is proposed to be\nlocated;\n (b) a description of the method by which industrial development\nagencies or other public finance agencies shall grant a preference for\nallocation of private activity bonding authority for projects located in\nthe proposed empire zone;\n (c)

§ 962. Empire zone development plan. An empire zone development plan\nshall be submitted for approval with the commissioner and with the local\nempire zone administrative board, and shall demonstrate the methods by\nwhich the applicant intends to promote the development of new business\nand the expansion of existing business within the empire zone and shall\ninclude, but shall not be limited to:\n (a) a statement indicating how empire zone designation would assist in\nthe revitalization of the area in which such zone is proposed to be\nlocated;\n (b) a description of the method by which industrial development\nagencies or other public finance agencies shall grant a preference for\nallocation of private activity bonding authority for projects located in\nthe proposed empire zone;\n (c) a description of proposals for infrastructure improvements and\ninvestments and a timetable for their completion;\n (d) a statement identifying those local tax incentives proposed to be\noffered within the zone;\n (e) a description of a procedure to expedite the issuance of any\nrequired local permits or licenses;\n (f) a description of other activities to be undertaken by municipal\nagencies, business entities, not-for-profit corporations,\ncommunity-based organizations or any other persons, which are designed\nto promote private sector business investment and job development in the\nempire zone and a description of the job training or job placement\nservices to be made available to empire zone residents in need of such\ntraining or services;\n (g) an inventory of real property located within the proposed empire\nzone that is owned by a municipality or the state and is currently\nunused by the municipality or the state;\n (h) a description of the business development programs and services to\nbe available to stimulate the creation of new small businesses,\nincluding new small minority and women business enterprises;\n (i) a description of efforts that will be undertaken to prevent or\ndiscourage the displacement of residents of the proposed empire zone;\n (j) a description of activities designed to ensure the meaningful\nparticipation of minority-owned and women-owned business enterprises in\nempire zone development activities;\n (k) a description of provisions for the participation of\nnot-for-profit and business corporations in the development of the plan\nand in strategies for implementation of the plan;\n (l) a description of the marketing strategy to be employed by the\napplicant to promote business development in the zone and the resources\nto be committed by the applicant and other organizations to the\nimplementation of such strategy;\n (m) a description of the method by which the applicant will evaluate\nthe success of any activities to be undertaken in the proposed empire\nzone, provided, however, that the applicant shall take into\nconsideration the factors upon which the selection of the area was based\nin any evaluation;\n (n) a description of provisions for participation and allocation of\nfunds by the affected service delivery area private industry council and\nadministrative entity established pursuant to the job training\npartnership act (P.L. 97-300, as amended) to provide job training in the\nzone;\n (o) a statement of the reasons why the particular geographic\nconfiguration of the zone was selected;\n (p) a description of the structure and duties of the local zone\nadministrative board to be established within each empire zone as\nprovided in section nine hundred sixty-one of this article;\n (q) a description of the special programs to be operated by\neducational institutions and other training entities in the area to\nprepare and train zone residents for employment by businesses located\nwithin and outside the zone;\n (r) a statement from the appropriate regional economic development\ncouncil setting forth the specific resources to be allocated for\nbusiness development in the zone;\n (s) a description of facilities for licensed and certified child day\ncare for the children of persons engaged in training for employment in,\nor employed in, the zone;\n (t) description of specific strategies and priorities for economic\nrevitalization of the zone and of indicators to be used to measure\nperformance against objectives;\n (u) a statement of human resource development goals for the empire\nzone and specific strategies for achieving them;\n (v) a description of how the applicant will use zone designation to\ncoordinate economic development programs and providers at the local\nlevel to service the zone;\n (w) a description of the organizational actions to be taken by the\nlocal empire zone administrative board and zone administrative entities\nto implement specified business, community and human resource\ndevelopment goals and strategies;\n (x) a description of the financial commitments which the applicant is\nprepared to make to the zone, including, but not limited to, specific\ncommitments for infrastructure improvements;\n (y) a description of how the local economic development entities, as\ndescribed in paragraph (xii) of subdivision (b) of section nine hundred\nsixty-one of this article will integrate its services to allow for the\nbest possible economic development support for the zone;\n (z) any zone designated prior to the enactment of this paragraph shall\nsubmit a new development plan, as defined pursuant to this section, in\nconjunction with the requirements set forth in subdivision (d) of\nsection nine hundred fifty-seven of this article which the commissioner\nshall approve or disapprove such plan within ninety days of submission;\n (aa) the development plan established pursuant to this section shall\nbe resubmitted by the local zone administrative board as economic\nconditions change within the zone, or when other factors trigger a need\nfor a change in the development plan as determined by the local zone\nadministrative board;\n (bb) a description of specific strategies and actions taken by the\nlocal empire zone administration board and zone administrative entities\nto integrate economic goals with the objectives of community well-being\nand environmental protection, such as open space protection, that will\npromote new development patterns in order to take advantage of resources\nand opportunities, such as existing public sewer and water\ninfrastructure, without compromising the needs of future generations;\nand\n
