§ 72-P*2 — Establishment of farmers' markets

* § 72-p. Establishment of farmers' markets. 1. The governing body of\nany municipal corporation may establish one or more farmers' markets, as\ndefined in section two hundred sixty of the agriculture and markets law,\nfor public purposes and in the exercise of its public powers.\n 2. Such municipal corporation shall have the power, charge and\nauthority to:\n a. construct, repair, maintain and manage all farmers' markets, market\nplaces and market lands of such municipality, and all buildings,\nstructures and facilities thereon;\n b. fix fees for services, licenses and privileges and rent space\ntherein and enter into leases therefor;\n c. promulgate guidelines, regulations or rules for the governance of\nfarmers' markets, market places and market lands, not in conflict with\nthe rules and regulations of the department of agriculture and markets,\nand subject to the approval of the governing board of such municipal\ncorporation;\n d. grant or revoke licenses to auctioneers of food in such markets and\nfix a schedule of commissions to be charged by auctioneers;\n e. grant, transfer or revoke permits to buy or sell in such market or\nupon such market places or land; and\n f. investigate any complaint in relation to the shipment of food to\nany farmers' market of the municipality.\n 3. Nothing in this section shall abridge the powers of local boards or\ndepartments of health as otherwise provided by law.\n * NB There are two § 72-p's\n
