§ 750-h. Denial of license application and suspension and revocation\nof licenses. 1. An application for a license under this article may be\ndenied or a license to engage in the business of operating a pet\ncemetery or pet crematorium may be suspended or revoked, by the\nsecretary of state, for any one or more of the following causes:\n (a) Fraud or bribery in securing a license;\n (b) The making of any false statement as to a material matter in any\napplication or other statement or certificate required by or pursuant to\nthis article;\n (c) Incompetency in the operation of a pet cemetery or pet\ncrematorium;\n (d) Failure to display the license as provided in this article;\n (e) Violation of any provision of this article, or of any rule or\nregulation adopted hereunder;\n (f) Conviction of a crime involving fraud, theft, perjury or bribery\nor other cause which would permit disqualifications from receiving a\nlicense upon the original application;\n (g) Failure to retain all pet disposal forms for a period of two years\nfollowing receipt;\n (h) Failure to comply with the duties of a pet cemetery owner or\noperator as set forth in section seven hundred fifty-v of this article;\nand\n (i) Conviction of a violation of article twenty-six of the agriculture\nand markets law involving cruelty to animals.\n 2. Whenever the license to engage in the business of operating a pet\ncemetery or pet crematorium is revoked, such license shall not be\nreinstated or reissued until after the expiration of a period of five\nyears from the date of such revocation and the secretary of state\napproves the license application pursuant to section seven hundred\nfifty-e of this article.\n
