§ 14. Cooperation and assistance from other state agencies.
1.The\ndepartments of health, mental hygiene and law, the division of the\nbudget, the office of general services, the state housing finance\nagency, the state medical care facilities finance agency, the state\nagency designated to implement an act of congress known as the\ncomprehensive health planning and public health services amendments of\nnineteen hundred sixty-six (Public Law 89-749) and all other state\nagencies shall cooperate with and assist the corporation in the\nfulfillment of its corporate purposes and in the exercise of its\ncorporate powers under this act and may render such services to the\ncorporation within their respective functions as the directors of the\ncorporation may reasonably request.\n 2. § 14. Cooperation and assistance from other state agencies. 1. The\ndepartments of health, mental hygiene and law, the division of the\nbudget, the office of general services, the state housing finance\nagency, the state medical care facilities finance agency, the state\nagency designated to implement an act of congress known as the\ncomprehensive health planning and public health services amendments of\nnineteen hundred sixty-six (Public Law 89-749) and all other state\nagencies shall cooperate with and assist the corporation in the\nfulfillment of its corporate purposes and in the exercise of its\ncorporate powers under this act and may render such services to the\ncorporation within their respective functions as the directors of the\ncorporation may reasonably request.\n 2. Subject to the approval of the office of alcoholism and substance\nabuse services and to the terms of any lease, sublease or other\nagreement with the state housing finance agency, the corporation,\nwhether as principal or as agent for the state housing finance agency,\nis hereby authorized and empowered to provide facilities for the conduct\nof alcoholism or substance abuse treatment programs by the office of\nalcoholism and substance abuse services and as may be required by such\noffice in the performance of its duties, powers and functions as\nspecified in article nineteen of the mental hygiene law, including\nconstruction, acquisition, reconstruction, rehabilitation, alteration\nand improvement of buildings, structures and appurtenances, the purchase\nand installation of furnishings and equipment, the acquisition of\nproperty by purchase, lease or transfer, engineering, architectural and\nconsulting services. In the design, construction, acquisition,\nreconstruction, rehabilitation, alteration and improvement of such\nfacilities the corporation shall be guided by the provisions of this act\nrelating to the design and construction of mental hygiene facilities,\nprovided, however, that subject to the terms of any lease, sublease or\nother agreement with the state housing finance agency such facilities\nand the approvals to be given for the design and construction thereof\nshall be under the professional jurisdiction of the office of alcoholism\nand substance abuse services and the corporation shall make such\nfacilities available to such office.\n 3. Notwithstanding the provisions of subdivision five of section nine\nof this act, the directors of the corporation, subject to the terms of\nany lease, sublease or other agreement with the state housing finance\nagency, shall make available to the office of alcoholism and substance\nabuse services for use as an alcoholism or substance abuse facility any\nreal property or facility under the jurisdiction of the corporation as\nthe office of alcoholism and substance abuse services shall request and\nthe commissioner shall certify is no longer necessary for use in the\ncare, maintenance and treatment of the mentally disabled. Such real\nproperty or facility shall continue under the professional jurisdiction\nof the office of alcoholism and substance abuse services until such\noffice shall certify that such real property or facility is no longer\nnecessary for use as an alcoholism or substance abuse facility,\nwhereupon all of the provisions of subdivision five of section nine of\nthis act shall govern. Responsibility for the maintenance and upkeep of\nsuch real property or facility, for the maintenance and routine repair\nof such real property or facility and for the replacement of\nfurnishings, equipment, apparatus and machinery shall, subject to the\nterms of any lease, sublease or other agreement with the state housing\nfinance agency, be in the office of alcoholism and substance abuse\nservices so long as such real property or facility is under the\nprofessional jurisdiction of such office. A copy of any certificate made\npursuant to this subdivision shall be filed with the director of the\nbudget.\n
