§ 804. General powers and duties of the agency. The agency shall have\nthe power:\n 1. To sue and be sued;\n 2. To make and execute contracts and all other instruments necessary\nor convenient for the exercise of its powers and functions under this\narticle;\n 3. To establish and maintain such facilities as may be necessary for\nthe transacting of its business;\n 4. To appoint an executive officer, officers, agents, employees, and\nprescribe their duties and qualifications and fix their compensation;\n 5. To utilize to the extent feasible the staff and facilities of\nexisting state agencies, pursuant to an allocation to be made by the\ndirector of the budget;\n 6. To hold hearings and subpoena witnesses in the exercise of its\npowers, functions and duties provided for by this article;\n 7. To contract for professional and technical assistance and advice;\n 8. To contract for and to accept any assistance, including but not\nlimited to gifts, grants or loans of funds or of property from the\nfederal government or any agency or instrumentality thereof, or from any\nagency or instrumentality of the state, or from any other public or\nprivate source and to comply, subject to the provisions of this article,\nwith the terms and conditions thereof, subject to the approval of the\ndirector of the budget;\n 9. To adopt, amend and repeal, after public hearing (except in the\ncase of rules and regulations that relate to the organization or\ninternal management of the agency), such rules and regulations,\nconsistent with this article, as it deems necessary to administer this\narticle, and to do any and all things necessary or convenient to carry\nout the purposes and policies of this article and exercise powers\ngranted by law; and\n 10. To report periodically to the governor and the legislature on the\nconduct of its activities but not less than once a year, furnishing a\ncopy of each such report to the clerk of the county legislative body of\neach county wholly or partly within the park and to the review board.\n
