§ 40-0103. Applicability.\n This article applies to all storage facilities which are used for the\nstorage of hazardous substances, except that this article shall not\napply to any storage facilities, regulated under:\n 1. Title 7, 9 or 11 of article 27 of this chapter;\n 2. The Natural Gas Pipeline Safety Act of 1968 (49 U.S.C. § 1671 et\nseq.);\n 3. The Hazardous Liquid Pipeline Safety Act of 1979 (49 U.S.C. § 2001\net seq.);\n 4. The Natural Gas Act (15 U.S.C. § 717 et seq.);\n 5. The Liquefied Natural and Petroleum Gas Act (Title 17 of article 23\nof this chapter); or\n 6. Provisions relating to liquid petroleum pipeline corporations\n(article 3-C of the public service law); or\n 7. The Atomic Energy Act of 1954, as amended (42 U.S.C. § 2011 et\nseq.).\n
