§ 5-108-a. Energy efficient appliances.
1.The president of the New\nYork state energy research and development authority, in consultation\nwith the commissioner of the office of general services, shall\npromulgate minimum energy efficiency standards for appliances and energy\nusing products purchased by or for the state or any agency thereof in\naccordance with the following schedule: by April first, two thousand\ntwo, fluorescent lamp ballasts, central air conditioners, room air\nconditioners, package terminal air conditioners and heat pumps; by\nOctober first, two thousand two, electric motors, refrigerators,\nfreezers, refrigerator-freezers, water heaters, lamps and luminaries;\nand by April first, two thousand three, dishwashers, clothes washers,\nclothes dryers, furnaces, boilers a

Additional minimum\nenergy efficiency standards for appliances and energy using products may\nbe added by the president of the New York state energy research and\ndevelopment authority, in consultation with the commissioner of the\noffice of general services. Establishing minimum energy efficiency\nstandards for appliances and energy using products shall be based on\ncost-effectiveness criteria and may be waived in the event that such\nappliances or products are not widely available, or for other reasons as\ndetermined by the president of the New York state energy research and\ndevelopment authority, in consultation with the commissioner of the\noffice of general services. Such standards shall be designed to achieve\ncost effective savings to the maximum extent practicable, taking into\naccount market availability.\n 2. New or replacement appliances or products purchased by or for the\nstate or any agency thereof shall meet or exceed standards promulgated\npursuant to this section, and all building designs or specifications for\nnew construction or substantial renovation for any building owned or\nleased in whole by the state or any agency thereof shall incorporate\nappliances or products which meet or exceed such standards.\n
