§ 6912. Clinical education in New York state nursing education\nprograms.
1.For purposes of this section, "simulation experience" shall\nmean planned learning experiences that represent actual or potential\nsituations in clinical nursing practice and adhere to the standards of\nthis section. Such learning experiences allow participants to develop or\nenhance clinical nursing competencies and provide an opportunity to\nanalyze and respond to realistic situations in a simulated environment.\n 2. New York state certificate and degree programs registered by the\ndepartment for the purposes of meeting the education requirements set\nforth in this article shall include clinical education, or the\nequivalent as defined and determined by the commissioner pursuant to\nregulation.\n 3. § 6912. Clinical education in New York state nursing education\nprograms. 1. For purposes of this section, "simulation experience" shall\nmean planned learning experiences that represent actual or potential\nsituations in clinical nursing practice and adhere to the standards of\nthis section. Such learning experiences allow participants to develop or\nenhance clinical nursing competencies and provide an opportunity to\nanalyze and respond to realistic situations in a simulated environment.\n 2. New York state certificate and degree programs registered by the\ndepartment for the purposes of meeting the education requirements set\nforth in this article shall include clinical education, or the\nequivalent as defined and determined by the commissioner pursuant to\nregulation.\n 3. Registered programs may deliver one-third of such clinical training\nor clinical education through simulation experience as defined in this\nsection and in accordance with the commissioner's regulations, provided,\nhowever, nothing in this section shall reduce the minimum in-person or\ndirect care requirements established by programmatic accreditors and\ncertifying bodies. To meet a particular educational need the\ncommissioner may approve that more than one-third of such clinical\ntraining or clinical education may be met through simulation experience\nas defined in this section and in accordance with the commissioner's\nregulations.\n 4. The commissioner shall prescribe in regulation an expedited process\nfor programs seeking a curricular change to implement simulation\nexperiences. For programs that are not in substantial compliance with\ndepartment program requirements, the department may request additional\ninformation and materials, in accordance with the commissioner's\nregulations. The department shall act upon a program's submission to\nimplement simulation experiences within twenty business days of receipt\nof a complete and properly submitted form.\n 5. Simulation experience acceptable to the department for the purposes\nof clinical training or clinical education shall:\n (a) be designed, guided and supervised by program faculty and program\nstaff with appropriate and relevant training, certification or\naccreditation, who may be assisted or supported by experts in\nsimulation, in a nursing skills or clinical simulation laboratory\nsetting;\n (b) include continued professional development opportunities for\nprogram faculty and program staff in simulation methods and best\npractices;\n (c) utilize theory-based, evidence-based, and standards-driven\npedagogy;\n (d) require active student engagement in guided skills practice with\ninstructional feedback;\n (e) include formative and summative assessments of well-articulated\ncompetencies appropriate to the role and responsibilities of the\nlearner;\n (f) use various types of fidelity through equipment and practice to\nreplicate substantial aspects of clinical nursing practice and utilize\nrelevant equipment and technologies as appropriate to the desired\nlearning outcomes;\n (g) maintain continued compliance with the standards of program\nregistration; and\n (h) respond to innovations or emerging educational needs, pursuant to\nregulation.\n
