§ 359-d. Eligibility criteria.

1.To be a participant in the\nsemiconductor research and development project program, a business\nentity shall operate in New York state and be undertaking a\nsemiconductor research and development project as defined in section\nthree hundred fifty-nine-c of this article.\n 2. A business entity must be in compliance with all worker protection\nand environmental laws and regulations. In addition, a business entity\nmay not owe past due state taxes or local property taxes unless the\nbusiness entity is making payments and complying with an approved\nbinding payment agreement entered into with the taxing authority.\n
