§ 301. Definitions. When used in this article, the following words and\nphrases shall have the following meanings unless the specific context\nclearly indicates otherwise:\n 1. "Municipality" means any county except a county wholly contained\nwithin a city and any city having a population of one million or more\npersons.\n 2. "Board" means the board of supervisors of a county or an elected\ncounty legislative body or city legislative body by whatsoever name\ndesignated.\n 3. "E911 system" means an enhanced emergency telephone service which\nautomatically connects a person dialing the digits 9-1-1 to an\nestablished public service answering point and which shall include, but\nnot be limited to, selective routing, automatic number identification\nand automatic location identification.\n

"911 service area" means the area within the geographic boundaries\nof a county which has established an E911 system.\n 5. "Public safety agency" means a functional division of a public\nagency which provides or has the authority to provide police,\nfirefighting, emergency medical or ambulance services or other emergency\nservices or a private entity which provides emergency medical or\nambulance services.\n 6. "Public service answering point" means a communications facility\nwhich first receives 911 calls from persons within a 911 service area\nand which may, as appropriate, directly dispatch the services of a\npublic safety agency or extend, transfer, relay or otherwise route 911\ncalls to the appropriate public safety agency.\n 7. "Service supplier" means (i) a telephone corporation which provides\nlocal exchange access service within a 911 service area, or (ii) a\nprovider of "voice over internet protocol service" or "VOIP service"\nthat provides such service within a 911 service area.\n 8. "System costs" means the costs associated with obtaining and\nmaintaining the telecommunication equipment, all operations and\nmaintenance costs and the telephone services costs necessary to\nestablish and provide an E911 system.\n 9. "Wireless communications device" means any equipment used to access\na wireless communications service.\n 10. "Wireless communications service" means all commercial mobile\nservices, as that term is defined in section 332(d) of title 47, United\nStates Code, as amended from time to time, including, but not limited\nto, all broadband personal communications services, wireless radio\ntelephone services, geographic area specialized and enhanced specialized\nmobile radio services, and incumbent-wide area specialized mobile radio\nlicensees, which offer real time, two-way voice or data service that is\ninterconnected with the public switched telephone network or otherwise\nprovides access to emergency communications services.\n 11. "Place of primary use" shall mean the street address\nrepresentative of where a wireless communications customer's use of the\nwireless telecommunications service primarily occurs, and must be: (i)\nthe residential street address or the primary business street address of\nthe wireless communications customer and (ii) within the licensed\nservice area of the wireless communications service supplier.\n 12. "Wireless communications service supplier" means any commercial\nentity that operates a wireless communications service in New York\nstate.\n 13. "Voice over internet protocol service" or "VOIP service" shall\nmean any service that (i) enables real-time, two-way voice\ncommunications; (ii) requires a broadband connection from the user's\nlocation; (iii) requires internet protocol compatible customer premises\nequipment (CPE); and (iv) permits users generally to receive calls that\noriginate on the public switched telephone network and to terminate\ncalls to the public switched telephone network.\n
