§ 256-a. Consolidation of Suffolk county sewer district number two -\nHolbrook and Suffolk county sewer district number four - Birchwood North\nShore.
1.The county legislature of Suffolk county is hereby authorized\nto consolidate Suffolk county sewer district number two Holbrook and\nSuffolk county sewer district number four - Birchwood North Shore in\naccordance with the procedure contained in this section.\n 2. Resolution. The county legislature of Suffolk county may adopt a\nresolution calling a public hearing upon the proposed consolidation of\nSuffolk county sewer district number two - Holbrook and Suffolk county\nsewer district number four - Birchwood North Shore.\n 3. Notice. The clerk of the county legislature shall give notice of\nthe hearing described in subdivision two of

§ 256-a. Consolidation of Suffolk county sewer district number two -\nHolbrook and Suffolk county sewer district number four - Birchwood North\nShore. 1. The county legislature of Suffolk county is hereby authorized\nto consolidate Suffolk county sewer district number two Holbrook and\nSuffolk county sewer district number four - Birchwood North Shore in\naccordance with the procedure contained in this section.\n 2. Resolution. The county legislature of Suffolk county may adopt a\nresolution calling a public hearing upon the proposed consolidation of\nSuffolk county sewer district number two - Holbrook and Suffolk county\nsewer district number four - Birchwood North Shore.\n 3. Notice. The clerk of the county legislature shall give notice of\nthe hearing described in subdivision two of this section in such\nnewspapers and within such time period as set forth in section two\nhundred fifty-four of this article. Such notice shall specify the time\nwhen and the place where such hearing will be held and, in general\nterms, describe the proposed consolidation and the proposed basis of the\nfuture assessment of all costs of operation, maintenance and\nimprovements of such consolidated sewer district.\n 4. Hearing. The county legislature shall meet at the time and place\nspecified in such notice and hear all persons interested in the subject\nmatter thereof concerning the same. If the county legislature shall\ndetermine that it is in the public interest to consolidate Suffolk\ncounty sewer district number two - Holbrook and Suffolk county sewer\ndistrict number four - Birchwood North Shore as specified in said\nnotice, the Suffolk county legislature may adopt a resolution, subject\nto a permissive referendum, so consolidating such sewer districts.\n 5. Notice of adoption of resolution. Within ten days after the\nadoption by the Suffolk county legislature of the resolution described\nin subdivision four of this section, the Suffolk county legislature\nshall give notice thereof, at the expense of the county, by the\npublication of a notice in such newspapers and within such time period\nas set forth in section one hundred one of this chapter. Such notice\nshall set forth the date of adoption of the resolution and contain an\nabstract of such resolution, describing, in general terms, the sewer\ndistricts so consolidated and the basis for the future assessment of all\ncosts of operation, maintenance and improvements and that such\nresolution was adopted subject to a permissive referendum.\n 6. Petition. The resolution of the Suffolk county legislature\ndescribed in subdivision four of this section shall not take effect\nuntil forty-five days after its adoption and shall be subject to\npermissive referendum in each sewer district proposed to be consolidated\nin accordance with the provisions of section two hundred fifty-seven of\nthis article.\n 7. Consolidation of Suffolk county sewer district number two Holbrook\nand Suffolk county sewer district number four - Birchwood North Shore.\nThe consolidation of Suffolk county sewer district number two Holbrook\nand Suffolk county sewer district number four - Birchwood North Shore\nshall become effective on the thirty-first day of December next\nsucceeding; provided, however, that if the resolution described in\nsubdivision four of this section shall be adopted subsequent to the\nfirst day of October in any year, such consolidation shall become\neffective on the thirty-first day of December of the next succeeding\ncalendar year. Upon such consolidation of Suffolk county sewer district\nnumber two - Holbrook and Suffolk county sewer district number four -\nBirchwood North Shore, all the property of such sewer districts shall\nbecome the property of the consolidated sewer district and the\nconsolidated sewer district shall assume and pay the indebtedness of\neach of such original sewer districts as if such indebtedness had been\nincurred subsequent to the consolidation.\n
