§ 136-b. Approval of superintendent. The superintendent shall approve\nor disapprove of a proposed merger as authorized by section one hundred\nthirty-six of this article or a proposed acquisition of all or a\nsubstantial part of the assets of a national banking association as\nauthorized by section one hundred thirty-six-a of this article, as the\ncase may be, within one hundred twenty days after the submission of the\nproposed plan thereof to him or her. In determining whether to so\napprove, the superintendent shall take into consideration (i) the\ndeclaration of policy contained in section ten of this chapter, (ii)\nwhether the effect of such merger or acquisition shall be either to\nexpand the size or extent of the resulting or acquiring institution\nbeyond limits consistent with ad
