§ 34.03. Definitions. The following terms as used in this article\nshall have the following meanings:\n 1. "Performing group" means any vocal or instrumental group seeking to\nuse, using, advertising the use of, or promoting the name of a recording\ngroup that has previously released a commercial sound recording under\nthe name of such recording group.\n 2. "Recording group" means any vocal or instrumental group at least\none of whose members has previously released a commercial sound\nrecording under that group's name and in which such member or members\nhave a legal right by virtue of use or operation under the group name\nwithout having abandoned the name or affiliation with the group.\n 3.
