§ 1304 — Unclaimed personal property of persons in certain state institutions

§ 1304. Unclaimed personal property of persons in certain state\ninstitutions. 1. The following unclaimed property belonging or credited\nto a discharged, deceased or escaped person in an institution under the\njurisdiction of the department of social services, the department of\nhealth, the department of mental hygiene, the executive department, or\nthe department of corrections and community supervision shall be deemed\nabandoned property:\n (a) Any moneys or intangible personal property which has been\ninventoried pursuant to section one hundred twenty-eight of the state\nfinance law, and\n (b) Any proceeds, less lawful deductions, from a sale of tangible\npersonal property, other than money, pursuant to section one hundred\ntwenty-eight of the state finance law.\n 2. Any such abandoned property shall be paid or delivered forthwith to\nthe state comptroller. Such payment shall be accompanied by a written\nreport, affirmed as true and accurate under penalty of perjury, setting\nforth such identifying information as the state comptroller may require.\n 3. The rights of any such discharged, deceased or escaped person in or\nto any unclaimed passbook, negotiable instrument or other evidence of\nindebtedness or ownership delivered to the state comptroller pursuant to\nthis section shall pass to the state comptroller as custodian under this\nchapter.\n
