§ 2585. Continuation in office of boards, bureaus, teachers,\nprincipals and other employees, et cetera. 1. Except as otherwise\nprovided herein the boards, bureaus, teachers, principals, supervisors,\nsuperintendents, heads of departments, assistants to principals,\nexaminers, supervisors of lectures, directors and all other officers and\nemployees of the school systems or of boards of education of the several\ncities of the state, lawfully appointed or assigned before June eighth,\nnineteen hundred seventeen, shall continue to hold their respective\npositions for the term for which they were appointed or until removed as\nprovided in subdivision five of section twenty-five hundred twenty-three\nof this article.\n 2. If a board of education abolishes an office or position and creates\nanother office or position for the performance of duties similar to\nthose performed in the office or position abolished, the person filling\nsuch office or position at the time of its abolishment shall be\nappointed to the office or position thus created without reduction in\nsalary or increment, provided the record of such person has been one of\nfaithful, competent service in the office or position he has filled.\n 3. Whenever a board of education abolishes a position under this\nchapter, the services of the teacher having the least seniority in the\nsystem within the tenure of the position abolished shall be\ndiscontinued.\n 4. If an office or position is abolished or if it is consolidated with\nanother position without creating a new position, the person filling\nsuch position at the time of its abolishment or consolidation shall be\nplaced upon a preferred eligible list of candidates for appointment to a\nvacancy that then exists or that may thereafter occur in an office or\nposition similar to the one which such person filled without reduction\nin salary or increment, provided the record of such person has been one\nof faithful, competent service in the office or position he has filled.\nThe persons on such preferred list shall be reinstated or appointed to\nsuch corresponding or similar positions in the order of their length of\nservice in the system.\n 5.(a) The use of artificial intelligence systems as defined by section\none hundred three-e of the state technology law and automated\ndecision-making tools as defined by section five hundred one of the\nstate technology law shall not affect (i) the existing rights of\nemployees pursuant to an existing collective bargaining agreement, or\n(ii) the existing representational relationships among employee\norganizations or the bargaining relationships between the employer and\nan employee organization.\n (b) The use of such artificial intelligence systems and automated\ndecision-making tools shall not result in the: (i) discharge,\ndisplacement or loss of position, including partial displacement such as\na reduction in the hours of non-overtime work, wages, or employment\nbenefits, or result in the impairment of existing collective bargaining\nagreements; or (ii) transfer of existing duties and functions currently\nperformed by employees of the state or any agency or public authority\nthereof to an artificial intelligence system or automated decision\nmaking tool.\n (c) The use of such artificial intelligence system and automated\ndecision-making tool shall not alter the rights or benefits, and\nprivileges, including but not limited to terms and conditions of\nemployment and civil service status. The collective bargaining unit\nmembership status of all existing employees of the board of education\nshall be preserved and protected.\n
