of employment. A. An employee of the department who has access to or who is assigned to perform work associated with driver's licenses shall submit to a background investigation as required by the secretary. B. An applicant seeking employment with the department who may have access to or who may be assigned to perform work associated with driver's licenses shall submit to a background investigation as required by the secretary. C. The secretary shall ensure that fingerprints as required for a national criminal history records search and state background investigation are provided by:

(1)an employee of the department who has access to or is assigned to perform work associated with driver's licenses; or (2) an applicant seeking employment with the department who may have access to or who ma
