§ 33:1-30 — Sale of alcohols unfit for use as beverages; preparations and products excepted; violations; misdemeanor

This chapter is not designed to prohibit sales of denatured alcohol and alcoholic mixtures or composition or articles of commerce containing alcohol which are unfit for use as beverages without license hereunder. No provision of this chapter shall apply to alcohol intended for and actually used in the manufacture and sale of any of the following when they are unfit in fact for beverage purposes, namely: a. Denatured alcohol produced and used pursuant to acts of congress and regulations promulgated thereunder. b. Patent, proprietary, medicinal, pharmaceutical, antiseptic and toilet preparations. c. Flavoring extracts, syrups and food products. d. Scientific, chemical, mechanical and industrial products. Any person who shall knowingly sell, use or transport any of the products enumerated in paragraphs "a" , "b" , "c" or "d" for beverage purposes, or who shall use, sell or transport any of the same under circumstances from which he might reasonably deduce the intention of the purchaser or consignee to use them for such purposes shall be guilty of a misdemeanor. The commissioner shall have the power to investigate the sale, purchase, use and transportation of industrial alcohol as set forth above to the extent reasonably necessary to prevent conversion into alcoholic beverages fit for consumption.
