Text
a.The burden of proof required for in rem forfeiture proceedings under this act is by a preponderance of the evidence.
b.It shall not be necessary for the State to negate any exemption or exception set forth in any proceeding under this act, and the burden of proof for any such exemption or exception shall be upon the person claiming its benefit. L.1981, c. 387, s. 5, eff. Jan. 6, 1982.
